• Missing and damaged goods while shifting 2 BHK from Bangalore to Gulbarga - needed compensation

Dear Sir,

I shifted my home from Bangalore to Gulbarga. I took the service of the a movers and packers,

I faced below challenges while shifting from Bangalore to Gulbarga

1) They delivered the items 3 days delayed that too after too many follow ups.
2) They damaged my 2 items(Shoe rack and chair) and did not deliver ( Cooking cylinders, TV, Washing stand and baby chair)
3) After too many follow ups, they delivered via Delhivery courier after 2 weeks. These 2 weeks my family has to eat food from outside.
4) When I received the courier to my shock the LG 42 inch TV display was broken, The company is telling me that they will provide me compensation but I have to call n number of times and still no progress. It is almost month now.

My question is that, how can I file case in consumer court.

1) The logistics company name is "Ryder Movers and Packers" from Bangalore. I am not sure who is the owner, on whom should I file the case against?
2) They have not insured the shifting they are telling me that it was my mistake but truth is that they have not asked anything about insurance at all.
3) Can I claim for compensation for below items
TV worth of Rs,73000/- taken 11 years back(LG 42 inch LED TV)
 Shoe Rack worth of Rs.3000/-
 Chair worth of Rs.500/-
 Stand worth of approx Rs1500/-
Rs.27000/- paid for service to shift from Bangalore to Gulbarga
Rs.20000/- for eating food outside for almost 15 days.
and the mental harassment and agony we have gone through.

Please suggest me whether this case will stand what would be the major thing that will hinder for compensation. How to proceed further. Your guidance will be highly appreciated.

1. You can file the case against the company directly and not on the owner.

2. You cannot claim ignorance of law as an excuse.  No doubt it becomes your duty to enquire about such things in advance.

3. You can claim compensation.

- Since you have taken the services to shift the goods with the Ryder Movers and Packers , then the said firm is liable to pay for the damages and missing items legally.

- You can send him a demand legal notice to ask for the amount which you have calculated ,

- If no response, then you can file a compliant before the Consumer forum on the ground of deficiency of services and thereby ask for compensation as well for harassment .

You don't have to engage the lawyer from Bangalore itself to send the legal notice. You can engage the services of a chosen lawyer who may hail from any part of the country.

The lawyer fee for issuing the legal notice may be enquired from the chosen lawyer.
