• Water connection

I have a commercial shop in Mumbai since 1990. It was used by me for 9 years as a stationery shop. Later it was leased to a jewellery shop. There was no water connection in the shop and we did not opt for it since 1990. However, I have recently rented it to a food joint and they need the water connection. Society has been charging me water charges from 1990 as per bye law 69(a)(ii) but now they are not providing me the water connection. Can I just take the connection from the society tank at my own expense as there is absolutely no support from the society.

1) If society is charging you for water it is bound to provide you water connection 

 

2) you cannot take water connection from society tank without society approval 

 

3) if society refuses to supply you water take legal proceedings against society to provide you water for your shop 

 

4) you can issue legal notice to society to supply you water as you are paying for water connection

Dear Sir

As you have been paying the society for water since 1990, you are entitled to water connection.

I would suggest sending a legal notice regarding this.

It becomes the duty of the society to provide you water if they are charging for the consumption. 

You can demand the same and get the water supply connected to your shop also. 

If the society refuses to accept your request then you may approach consumer forum for deficiency in service and for compensation too.

- Yes, you can approach the society for getting the water connection and without getting approval you cannot connect the same. 

- Further, if you are paying maintenance charge and water charge etc., then society is bound to provide the connection 

- Further, before charging a commercial rate , the society should fix it through AGM.

- You can issue a legal notice to the management of the society if refuse to provide the water supply.
