• CRZ approval

We are looking to buy a riverside agriculture property in Dakshin Karnataka. The land is touching a river and is located more than 25 kms from the coast. if we need to construct a house on this land will CRZ restrictions apply? If restrictions apply what are the restrictions and do we need to take any approvals for construction. Thank you in advance.

A buffer of 45m is assumed all along the flow of river on both sides of banks which shall be treated as no development zone 

 

2) no building development  activity is allowed on bed of water bodies like nalla , full tank level of lake, pond etc

- Under the Karnataka Land Revenue Act, farmhouses can be built on agricultural land, of size not more than 10% of the landholding.

-  Further this farmhouse should be for residential purpose of family members only.

- Further , for constructing a house you need to convert the agriculture land into non agriculture land. 

- However, construction cannot be allowed near riverside .

1. The CRZ restrictions apply when-

  • In all Rules, the regulation zone has been defined as the area up to 500 m from the high-tide line.
  • The restrictions depend on criteria such as the population of the area, the ecological sensitivity, the distance from the shore, and whether the area had been designated as a natural park or wildlife zone.
  • The latest Rules have a no-development zone of 20 m for all islands close to the mainland coast, and for all backwater islands in the mainland.

You need to check whether the stretch comes under crz. Any notifications are issued etc. As per the notification, the coastal land up to 500m from the High Tide Line (HTL) and a stage of 100m along banks of creeks, estuaries, backwater and rivers subject to tidal fluctuations, is called the Coastal Regulation Zone(CRZ). CRZ along the country has been placed in four categories. The above notification includes only the inter-tidal zone and land part of the coastal area and does not include the ocean part. The notification imposed restriction on the setting up and expansion of industries or processing plaits etc. in the said CRZ.

Dear Sir,

If you go legally for getting permission for construction etc., you will have to face so many troubles. Better construct and then legalize if not approach the Civil Court and get an injunction order.

Central Government have declared the coastal stretches of seas, bays, estuaries, creeks, rivers and back waters which are influenced by tidal action (in the landward side) up to 500 mts. from the High Tide Line (HTL) and the land between the Low Tide Line (LTL) and the HTL as “Coastal Regulation Zone” (CRZ)

Since your property is situated 25 kms away from the coast perhaps you may not be required to obtain permission under the CRZ regulations.
