Kindly let me know if PTCL endorsement needed for a BDA approved layout.I am purchasing a plot from a direct allote who owns the plot for 12 years.the layout is formed on a non sc st land .ie the grant was given to a person who was not sc /st.

1) PTCL certificate is necessary only if the land at any point of time belongs to SC/ST candidates or it is a granted land. If it is not a granted land to any of the above then there is no necessity of PTCL document.
***** On perusal of the document it is seen that it is seen that Saguvali Chit is granted for 3 Acres of land to Smt. Muniyamma (Document at Sl No. 14) and Sri. Govindaswamy in Sy.no xxx Village, xxxHobli, Bengalore East Taluk. (Document is not clear)

The Tahsildar issues this endorsement stating that no proceedings have been initiated against the present owner of the property under the provisions of the Karnataka Scheduled Castes and Scheduled Tribes (Prevention of Transfer of Certain Lands) Act, 1978.

Hi, If the land has granted under the provisions of the SC & ST Act and there was a restriction for sale of land then that land become granted under the SC & ST Act. Normally, the Endorsement will issue like there is no proceedings is pending as per the provisions of the SC & ST Act. But it is better you can verify the entire documents and get legal opinion from the advocate.
The buyer can ask the builder/seller to get a Prevention of Transfer of Certain Lands Act (PTCL) endorsement. Either the Tehsildar or DC can issue this document. This is to ascertain that the property is not on land granted to person/persons belonging to the SC/ST communities.

You may not be able to understand the genuineness of the property by mere perusal of the documents produced before you by the vendor.
Hence you may approach an advocate to obtain a proper legal opinion and proceed to purchase only if recommended.

As the land was granted under the provisions of SC ST Act, it would be advisable to check the history of ownership and to verify for sure whether the previous owners belonged to SC or ST Communities.
To be on the safer side, you could try to obtain a PTCL endorsement for the land so that it does not become an issue in the future.
You can apply for the PTCL endorsement from the Tahsildar or Deputy District Collector of the area.
