• Can Revenue site be converted to atleast B Khata

I owe a Revenue site in Bangalore which i had bought in 2004. When i tried to take loan 5 years back against the same property, banks denied saying it doesn't have "mula patra". Now i recently tried taking loan against the same property with NBFC , but they said property has to be atleast B Khata and DC converted.When i checked for property details on BHOOMI KARNATKA LAND RECORDS website, i still see previous owner name against the property. But when i applied for EC online, i found my name in the property details. So looking for some advice on how to go ahead in converting my property to at-least B Khata and add make my property more secure.

You need to apply to Deputy Commissioner of the District for change of use of land from agricultural to non-agricultural use. Submit application form with copy of sale deed and ec with prescribed  fee. After Conversion Order is issued by DC make an application to Tahsildar enclosing conversion order, ec, sale deed for transfer to B Khata. Tahsildar will do the needful.

After the application is filed for converting the agricultural land to non-agricultural land, you may have to pay some betterment charges. DC conversion makes the land eligible for the Khata status - A or B.”

“For conversion, you may need necessary documents such as Chain of title, Sale Agreement and Mutation Extract,”

You got the property registered on your name by  registered sale deed, however you have not verified if the seller had the original or mother document at all.

Since the property revenue records are still in the name of the  vendor, and also since it has not been converted to NA, it becomes your duty to first get it transferred to your name in the revenue records and apply for getting the agricultural property  converted to NA.

You can get B khata only after completing this action.

You have not bothered to obtain a proper legal opinion at the time of purchasing the property which led you to suffer all these miseries.

Buying a revenue site is always troublesome for the buyer, hence your hasty decision made you to run from pillar to post without getting any relief from any quarter.

Even now you contact the vendor and get the property transferred to your name in the RTC and then apply for conversion to NA as per procedures and then apply for B khata.

Dear Querist

First of all, you should file an application before the revenue department (Tahsildar or SDM) for mutation and then apply for conversion of nature of the land, after taking all the evidence and after going through with the facts and circumstances of the matter, the concerned officer has the power to pass an order for converting the nature of land for use and directed to you to pay conversion charges as per law.

1. Obtain notarized copy of sale deed

2. Apply for an Encumbrance Certificate (EC) to register khata

3. Obtain application form to register khata

4. Fill up the application form to register Khata

5. Submit the application form to register khata

6. check the status of your registeration.
