My name is Brijesh and based in Singapore. I have properties in Bangalore and want to assign GPA to my brother-in-law for 2 things: 
1. Sale/purchase and associated administrative work
2. Operate - update details and close bank account, etc.

You can execute specific power of attorney in favour of close family relative like parents or siblings 

 

2) it would attract nominal stamp duty 

 

3) it should be attested before Indian consulate 

 

4) if executed in favour of brother in law it has to be stamped as conveyance and would attract high stamp duty

- You can give POA to your said relative for perform the assigned work on your behalf. 

- POA should be notarized as per rule of Singapore , and better to attested the same from the consulate of India.

Any immovable property can be sold, purchased or gifted  by person residing abroad through Special Power Attorney. The procedure is, draft a special power of attorney on Indian stamp paper of 100 rupees which  is available in all countries  or even on white paper giving SPA to any of you relatives/friend to sell/purchase the property.  Go to Indian consulate/high commissioner and get SPA attested which  the consulate official will readily do. Due to pandemic walk-ins are to Consulate are suspended, you can get the SPA attested online. Send the SPA to the person named, he will take the SPA to the District Registrar who will validate it by putting his seal and signature. Fee for validation of SPA is 1 % if it is given to blood relation if given to other person it is 2% of government valuation of the property. With the validated SPA you property can be sold by person named. In the same SPA your can also confer power on attorney to file/defend/mutate property in your favor.

It is possible to grant a power of attorney to your close family member or blood relative for the sale of property. A power of attorney does not require compulsory registration U/S 17(1)(b) for the simple reason that the donor by the execution of the document only authorizes the donee to act on his behalf and the instrument itself does not create, declare, assign, limit or extinguish any right, title or interest to or in immovable property. It has also been held that execution of deed of power of attorney is valid in law and subject to provision of the Act, is not compulsory registrable.

1. The GPA favouring the holder shall have to be drafted and sent the print out to you.

 

2. You shall have to append your  signature thereupon before the appropriate officer of your local Indian Consulate who will attest your said signature.

 

3. Thereafter the said GPA shall have to be stamped by the local Collector to make it valid in India.

 

4. Your GPA holder can now act based on the GPA executed by you.
