You have to sue to recover possession of farm
contact a local lawyer
Hi - you know that owning land is based on personal relationships and memories of agreements between often close relatives. The elders should be asked for details. How can we both (the couple that will own) get into the facts concerning the farm (forestryfarming) when one did not grow up on it or next door? It’s a bit of a crises actually. This farm is very old. It was the first Arla farm (mostly dairy) in our country. It was co-owned by to persons for generations that lend it to other for shorter time periods. The history and legal tradition ways down heavily on that farm. Not least because it has strong ties to bio farming (without the issues of defame and wrongful inheritance ever). There were for the longest time no issues relating to anything wrong on that farm. Nothing! We had to pretend that there were issues not to way down on other farm owners with issues not solved. Normally we leave the forest be. Biotopic. People on the farm live off other sources. How can we continue together as newly weds on a farm with such heavy traditions? //Jane Jarmo
How much does it cost to sue? Who pays for lawyers fees? //Jane Jarmo
Two persons in the first text above. What we meant to write. Not ”to persons” of course. //Jane Jarmo
It should say: lent it to ”others” also, not other. Quite a few people lived there (with no specific farming going on ever) for a while each. //Jane Jarmo
Since you are related to the farmland one or the other way down the inheritance line, you can occupy the farm land continue with the farming activities that were going on.
If t all anyone is questioning your authority, you may prove the same on the basis of documentary evidences for your ties with the predecessors or ancestors who owned the land and claim yourself to be the heirs or successors in interest to occupy and own the land for the purpose of continuing the heritage farming activities and the rights to own them in the capacity of successors in interest.
You do not have to start the lawsuit.
The person who objects to your usage or claim may go approach court with lawsuit disputing your title.
Then the litigation expenses including the lawyer's fee would be borne by the person intending to file the case against you.
Yes, the typo mistakes can be understood hence ignoring such petty mistakes, the right opinion to your question was rendered, you may go through the opinion carefully and arrive at a conclusion about what to do next.
The meaning what you wanted to convey was understood rightly while giving my opinion.
Even though there wa no formal activities in the farmland or disrupted in the recent past, you may start or resume the activities once again from your end.
You initiate the process and can deal with the person who object to your use of this property as per law when it becomes a litigation.
Dear Ma'am,
1. you will have to sue the person to regain possession of the land.
2. you may contact your local lawyer.
3. the feel will include the court fee and other expenses.
