• Registration of Land in revenue records of Kolkata Corporation

I bought a piece of land near Ruby General Hospital Kolkata ( Plot no. 68 of Scheme e in J.L. No. 12, Mouza Madurdaha, comprised in C.S.Dag No. 417, Revisional Khaitan No. 142, R.S.Dag No. 423, District 24 Parganas, Police Station Tollygunge, now Police Station Tiljala, Revenue Survey No. 212, Touzi No. 288, Sub-Registry Alipore ) in 2007, on the basis of a registered deed of conveyance. I have received a NOC from the fisheries Department. The previous owner had not paid any tax on this land. I would like to get it registered in the revenue records and clear all outstanding tax. Please advise the process.

At first, please procure the scheduled application form for Mutation called Form (A-42). This can be obtained from Central Record Section in the CMO building. It is also available in Gariahat (Tolly Tax) office at Behala (SSU) Office.

'No Outstanding Certificate' from Assessment Collection Department is required to be attached with the mutation form. For obtaining NOC from Assessment Collection Department single dedicated computerized window has been instituted at respective Assessment Collection Units (At CMO Buildings, Tolly Tax, SSU, JU & GRU office) from which either NOC or letter of Intimation (LoI) of demand will be handed over within a specified time limit.

In case of Mutation on succession ground death certificate of the R/O and an affidavit regarding legal heirs (in case of intestate succession) or probated will (in case of testamentary succession)

In case of mutation and apportionment of the tax, please submit a site-plan duly signed by an LBS and the applicant(s) showing the entire area of the premises as well the area(s) under the occupation of the individual applicant(s) along with the form of mutation.

Hello, 

  1. All you will have to do is to submit a copy of the Registered Deed of conveyance and the NOC from the fisheries department to the Local Revenue records office along with an application for mutation of the property in your name. 
  2. Once the mutation happens after verification by the revenue department, you can pay the outstanding tax and regularise the records.

You can clear your outstanding taxes at Kolkata Municipal Corporation and you may simply register your land by following the below-mentioned step by step procedure:

  1. Visit West Bengal Property Registration Department Portal, E-Nathikaran (just type it in google, it would be the first result)
  2. Scroll down and click on ‘e-requisition Form Filling’. Here you need to fill a form for market value assessment, stamp and registration fee.
  3. Being a new user you need to select ‘Fill up new requisition form’. If you are logging back again, you can finish your incomplete requisition form. You can also modify the e-requisition form and submit additional information about deeds, before its presentation at the sub-registrar’s office.
  4. You will be redirected to a guidelines page, where you can read the terms and conditions and rules for filling up the assessment form. Select ‘Read and Please Proceed’.
  5. You need to fill three forms. The first form is ‘Applicant and Transaction’. Here, you need to feed the applicant’s details, property details and transaction-related details. The applicant could be the buyer, advocate, seller, deed writer, solicitor firm or attorney of the claimant. Save the form.
  6. Once you save the form, the user will be redirected to the next form – ‘Details of Seller’. Fill the details and save the form. You can also add details of more than one seller, if it is a joint property.
  7. Fill the details of the buyers in the next form. Add all the required details or the form will be deemed incomplete. Mention the name of all the joint buyers.
  8. In the last form, you need to add identifiers or witness details.
  9. In the next section, mention the details of the property, such as district, local body, ward number, etc.
  10. Once you save the form, you need to select the registration office or the place where you want to register the deed. Select the suitable office and generate your query number. This number will be used for stamp duty payment.
  11. After that you’ll have to prepare, submit and execute e-Deed before you proceed to the sub-registrar’s office. Later, you have to book e-appointment at SRO’s office
  12. Present yourself at the SRO office where your documents will be verified and uploaded. Take all the original documents, along with the attested photocopies. Here, your deed will be scanned and fingerprint and signature will be captured, if you have not executed your e-Deed in Step 11.

Once the application is verified, your deed will be delivered, which will be digitally signed by the registrar’s office. Once registered, you can login and download the certified copy of a deed, by submitting the deed number and other details as required.

If you already have a registered sale deed on your name, you need not get it registered once again.

Moreover the revenue department is not the registration department to register the properties.

If you would like to transfer the revenue records you may approach the concerned revenue department or the Tehsildar for the needful by complying with the procedures of law.

- Mutation of a property or land is the change of title ownership from one person to another person when a property is sold or transferred.

- Further, by mutating a property or land, the new owner gets the title of the property recorded on his/her name in the land revenue department, and the government of West Bengal can charge property tax from the rightful owner.

- Since, the said property has already transfer in your name by way of Registered conveyance deed , then you can apply for mutation and to pay the taxes in your name legally. 

- The following documents are needed for apply the same 

  • Application for Mutation with a stamp affixed
  • Sale deeds
  • Affidavit on stamp paper of requisite value
  • Receipt of up-to-date property tax payment
  • Ration Card/any identity proof /residential proof

Dear Sir/Maam,

1) You will have to submit an application at local civic body (to Tehsildar) or at revenue office. In the application form, you may have to provide personal details, property address, registration date, type of transfer (gift/registered sale deed/Will deed etc), property particulars etc.,

2) You have to pay applicable fees through Demand Drafts. 

3) Enclose the required documents along with the application and DDs.- Copy of Sale Deed, Indemnity Bond & Affidavit, AND Latest property tax receipt

4)Once you submit all the required documents, the assessing officer (or) revenue inspector will check the documents, may visit the property and will process the application. Generally they will issue Patta Certificate / Mutation Certificate / Khata Certificate after processing your application.
