Hello sir I am an unmarried girl. Im in realtionship with my boyfriend for almost 6 years then he left me alone because of his parents. And he married another girl whom his parents had shown. I alomst went to depression at that point. And because of my friends help i came back to normal again. After his marriage almost for 6 months he didnt spoke with me then after he contacted me back again becasuse of the love and trust i have on him i didnt ignored him. I too started talking and meeting him again i started relationship with him. He promised and make me trust him that he will divource his wife and then he will marry me like that. After his marriage also it been 7years im used and cheated by him. If i ask him to marry he is ignoring and he left me. Now i came again to depression sir Please help me how to complaint on him that he used and cheated me for almost 12years. Now he is happily living with his family and im the one who is suffering a lot because of him. How to complaint a case and how can i proceed further to take any action on him. 

He is working as a government teacher now. I don't want to leave him. 

Can I take any action on him legally? Will my case will be taken in police station or not?

Is my case will valid?

You can file case of rape against him as he had sex with you under promise of marriage

1. Complain against him in the jurisdictional Police Station for repeatedly raping and cheating you on the false promise of marriage.

- As per the Supreme Court,  When a man and a woman live together as husband and wife for a long term, the law will presume that they are legally married unless proved contrary.

- Further, the Protection of Women from Domestic Violence Act 2005 provides for the protection, maintenance and right of palimony to a live-in partner, if she complains.

- Hence, if you were in relationship for 12 years, then you can legally take actions against him.

- You should lodge a complaint against him before the police and higher official, after mentioning all the facts in details.

Dear ma'am,

Any false promise to marry with the intention to exploit the other party is an offence of rape under Section 375 of the Indian Penal Code. As your boyfriend gave you false promises about marriage for 12 years, your legal action will be valid.

You can also state that you have suffered mentally and gone through severe trauma because of his act of cheating, and your life has come to a standstill.

You shall first file an FIR for the aforementioned offence. There are many female organizations and the Women commission that can help you register the complaint soon. You can also file complaint in jurisdictional court directly if the police does not take action. After the court takes cognizance of the offence, you can fight your case against him and get him punished accordingly. Thank you.

You can very well approach law enforcing authority or police for lodging a complaint against him for cheating and breach of trust.

But the problem is that you already knew that he is married hence any complaint given by you stating that he is a married person but you were in relationship with him despite knowing the fact of his marital status,  may not be very effective. The police may not even entertain any complaint from your side.

Hence you may suppress the fact of knowing that he was married during your relationship, and can give a complaint against him for having sexual relationship with you on the false promise of marriage and now refusing to marry you on some flimsy reasons. 

You can contact the DSP of your residential jurisdiction and request to keep your name confidential while taking any legal action agaisnt him for the fear of getting your name spoiled in the society. 

You can request him to invoke the provisions of the latest Disha act also to punish the cheater. 

However you may have to provide substantial documentary evidences to police to invoke the clauses or provisions of the Disha act.

The Act provides the death penalty for offenses like rape, gang rape, and speeding up trials of such offense within 21 days.

The Act visualizes the execution of investigation within 7 working days and trial in 14 days from the date of filing the charge sheet, for gathering sufficient evidence and the passing of judgment, within the time period  21 days.

  • It has prescribed the death penalty for rape cases where there is adequate evidence.

File a Complaint against him in the local Police Station.

If the officials do not register a FIR then file the same before S.P.  If the Police do not take action then file a private complaint before the judicial first class magistrate court.

While it is not necessary that the mutual promises should be concurrent, both should be made within a reasonable time of one another. An action for breach of promise to marry may be taken by a man as well as a woman. In modern times there have been instances of successful actions by men.

But in your case you can file case of rape against him as he had sex with you under promise of marriage .

hello miss

if have to advice for you here then legally first- yes you can file the case of rape on him because he used you even after marriage. his life will be ruined due to this case but you will not get anything. also the views of courts is shifting so i do not recommend this thing.

 

second is general: you will not get anything by fighting or sticking to a person who has no feeling for you and who is just using you for his pleasure. be strong and develop some hatred for him then you will be able to get out of him. attach yourself with some one else.. it takes time but you will be out of it for sure. start your life afresh with someone else or find other reasons which you like like social service etc. i think you want someone in your life therefore suggesting you to find someone else and get settled. but if you want to drag him in legal issues then you can use the first advice.
