• HUF Karta Died, HUF Dissolved with No successor - Karta, parcenor, registry still pending

My Grandmother purchased a single Property from 4 HUFs - A,B,C,D HUFs 
Case History-
A,B,C,D HUFS were joint owners of the property.
"A, B, C, D" are also own brothers. 
This purchase happened 10 years back. 
The agreement was not registered then.


Case as on 2020
B,C,D - HUF Kartas have died, 
They do not have any sons, 
B.C,D HUF is dissolved,
The Female Parcenors are not traceable.

A is the only HUF whose Karta is alive & he is willing to cooperate. 

We want to get the registry done in the shortest time as A is unwell too. What should be the plan of Action?

1. APPLY for adjudication to the district IGR office for payment of any deficient Stamp Duty & Registration of Document, which is allowed by paying penalty & interest thereon. No need of the sellers interference or presence in this.

Deed of confirmation has to be executed by A and  surviving legal heirs of HUF of B,C,D 

 

it should be duly stamped and registered

The legal heirs of deceased BCD coparceners of HUF property have to execute the registered sale deed jointly along with A.

The registrar will not entertain the registration of sale deed without the legal heirs either jointly executing the sale deed or relinquishing their rights by executing a registered release deed in favor of remaining coparceners.
