• Is RTC required for converted land

I have property 80 cents of converted land in Harekala village panchayat, I have my Mutation record, Form 9 & 11 and EC in my name. I wanted to pay the land tax for the property and the village accountant is not accepting without RTC in my name. RTC is still showing previous landlords name and I understand from sources RTC is given only for agricultural property and not for converted property. Appreciate if anyone can throw some light on this.

1. IF Property is already Mutated /Transferred in the Revenue Records in your name, THEN no further documentary proceedings is required. Confirm on this. Land Revenue Tax can be accepted based on the Revenue Records.

Yes, it is true that RTC can't be issued for the converted land, so please get it mutated as converted land in the record of panchayat as converted land and pay tax accordingly.

Dear Sir,

Be understand that after conversion it lost its characteristic of Revenue Land.  You need not pay any tax to Village Accountant. 

 

It is a property comes under Gram Panchayat and you have to get fix the tax by the Secretary of the Gram Panchayat or PDO. If they did not co-operate then you have to approach the EO (Taluka Executive Officer)

Send RTI application seeking information whether RTC is required in your case or not.

If it is not required then for refusal to pay your tax you can file writ petition in high court.

Form 9 is a document issued by gram panchayat for non-agricultural properties in its jurisdiction as per Karnataka Panchayat Raj Act and contains the assessment list of building and land liable to taxation while Form-11 is a document issued by grama panchayat for non-agricultural properties in its jurisdiction. Form 11 register is also called as Register of Demand, Collection and Balance of land and building.

Mutation is the change of title ownership from one person to another when the property is sold or transferred. By mutating a property, the new owner gets the property recorded on his name in the land revenue department and the government is able to charge property tax from the rightful owner

 

The RTC (Record of Rights, Tenancy and Crops) is also known as Pahani. It is an important land record in Karnataka that is issued to the existing landowner. The documents include the owner details and all the land-related details such as: Information about the landowner.

This land record management system was introduced in 2000. It uses advanced online technology for land management under which all the manual Record of Rights (RTCs) which are examined at the time of data entry were digitized and made available to the citizen through Kiosk Centres. All the ownership or any other changes in the Record of Rights (RTCs) are executed through mutation as per the Karnataka Land Revenue (KLR) Act using the Land Records database.

Since the records are not updated in their data base, you might have been instructed to get the RTC transferred to your name.

You may apply for transfer of records in the RTC to your name if that is insisted as an essential document to consider the taxes to be paid to your name

- As per law, after mutation you are entitled to deposit the land revenue tax. 

- Hence , lodge a compliant before the Revenue officer .
