• Neighbour claiming compensation

Hi
We have a flat in Mumbai which has been vacant more than a year.
The neighbor below has claimed that there was water damage to his ceiling. He then went on to renovate his house and now asking for compensation.
We were made aware of this only in Oct this year. He said he complained to tenants earlier living there but we have had no complaint from the society up until now. Now that we know, we have taken action immediately by allowing the pluging of the water pipe into our flat. The neighbour is not interested in our help, he just wants us to pay him. I dont understand ,how he can renovate if there is water seeping through. Now that everything is in writing, he is denying the letters a d just wants the money.
Advice please
Regards

Kindly involve society in this matter and you give in writing to secratary and chairman of the society.

Plus write all details of the issue started till date. If the society is not taking interest than you can write this issue to sub registrar of the cooperative housing society of your area.

You don't entertain the demand made by the client.

You can inform him that his action of renovating his property is his problem and not yours.

You can ask him that whether he informed you about the renovation and sought your approval for the same before starting the process or had intimated you about the estimated cost involved or at least requested the association for rectification of the defect in your absence.

You may ask him to proceed through court of law if he still insists on his demand for compensation.

You can challenge his claim properly in the trial proceedings.

you need not to pay if there is no written communication to you. if he files case then contest it otherwise tell him that you are not liable for the damage to his house, if any actually happened, as there is no proof that damage was due to seepage in your flat. moreover he did not inform you earlier. do not worry. it is no liability case

- The claim of that neighbour is not legal and malafide for the purpose to extort amount from you, as if there is water seeping , then question of renovation doesn't arise , and it will not work as well.

- Dont pay any amount , as he has not ground to ask for money from you even after taking legal action.
