• Agricultural to non-agricultural and back to agricultural

Hello,

We converted our agricultural land into non-agricultural but due to change in plan we would like to convert it back to agricultural. We have not done any construction. What is the procedure to do it? I read somewhere that within one year if we don't do any construction, NA permission will be revoked and land is converted back to agricultural. Please provide the guidance.

Any agricultural land, converted for a non-agricultural purpose can be used for such converted purpose within a year from the date of issue of the conversion order.

If the land is not converted within the prescribed time, the conversion order will be withdrawn and the premium deposited will be relinquished to the Government.

1. The agricultural land has already been converted by the Authority to non-agricultural/residential property based on your application showing that the said land is not tilted for years and the surroundings have become non-agricultural area.

2. Under the given circumstances, it is hard to get back the agricultural status of the land since it will defy logic.

  • There is a time limit within which the conversion has to take place. If that timeline is breached, the owner will lose his right to change the land use.
  • Penalties are imposed on the owner, in case he uses the land for a purpose other than the one mentioned in his conversion application.

In some States in India, have a provision that if the purpose for which the land was converted is not carried out in a certain period of time, the permission is cancelled and the land reverts back to agricultural. So, any agricultural land, converted for a non-agricultural purpose, should be used for such converted purpose within the specified time from the date of issue of the conversion order, failing which the conversion order will be withdrawn and the amount of premium deposited will be forfeited to the State government.

- Once the competent authority is satisfied that the prescribed conditions have been met with, Change of Land Use approval can be granted.

- Further , the applicant should use the non agriculture land within one year from the date of getting approval , after demarcation and levelling of the land.

- Further , applicant should also inform in the office of the Tehsildar about the change of Land use within 30 days from the date of getting approval to make changes in the land records.

- Hence, if you have not use that land after getting converted into non agriculture land and not following the rules as mentioned above , then automatically it lost entity , and it will be treated as agriculture land.

You just don't have to pay the fees for converting land from agricultural to non agricultural and do not perform any further NA procedure. Ask your family members to visit in Collector office and withdraw the application applied for NA purpose.

1. You have already got your agricultural land converted to non agricultural land for making construction thereupon siting example that the constructions have taken place in surrounding area.

2. There is hardly any scope for you to ask for its reconversion to agricultural land for the purpose of tilting.

1. Enquire from the authority whether you can withdraw your said application and get the said approval cancelled or not.

2. Avoid asking the Authority to reconvert the NA land to Agricultural land.
