Hello.i am residing in USA and have Indian OCI As well.i am looking to change my first and last name in the USA.what is the legal process to do complete name change in india?my parents also have property in india,which will get transferred to me later.will the name change cause any issues when it comes to selling property?

Name change  has to be done by notification in official gazette in India and 2 local newspapers . Affidavit of name change is necessary 

2) your parents can execute gift deed or bequeath property to you by. will 

3) gift deed or will should mention your new name 

 

4) you would be at liberty to sell the property

Officially to change name,You have to apply for Gazette notification of change of your name. Once that's done with the receipt of the gazatte declaration a news paper notice/ public notice have to be made in one of the local and English dailies. You also will have to prepare an affidavit

 of the same to complete the procedure to change the name in the identification documents, like Adhaar,Passport,pan or any other documents except birth certificate. The application to change name in the identity documents can be applied with the copy of the gazatte notification, public notice and an affidavit starting the details. Once the Identity documents are changed you can use your new name.

The transfer of the property can be in the new name and there will not be any issues in selling and  if it is already in the old name you should mention both names in the sale deed.

Hi, you have to file a suit in the District and Session Court for change of name or else you have to make a declaration in Rs. 20/- stamp paper and thereafter, you have to make a paper publication for change of name in two news papers.

You may have to be an Indian citizen to change your name in India.

If you hold a foreign country passport perhaps you may not be eligible for change of name as per law in India.

However the procedures for name change in India is that you have to first prepare an affidavit giving old and new name and reasons, if any, for desiring to change the name.

You have to furnish bath the old and new names in the affidavit which is to be duly notarised.

Subsequently the notarised affidavit has to be published in  a local newspaper as well as government gazette publication.

The copy of the government gazette publication shall be the authentic proof for the changed name.

Change name procedure in India is called Gazette of ne change state or central. It depends upon you where you need to apply state or central. If you want to apply for international purposes then get central government.

  • Need affidavit notary of yours
  • Two newspapers advertisement English National newspaper and local language as per Indian address.

If you want you parents property it will be not any issue if you produce the gazette of name change and you are the legal heirs of your parents. No issues at all, Just get your change name on all mutation papers.

1. Get one affidavit affirmed before the 1st Class Judicial Magistrate in India affirming that you want to change your name to such and such for which all the concerned authorities are required to update their records with the changed name and issue you fresh certificat5es/passport etc.

 

2. Thereafter publish a notice to that effect in local Gazette and two local dailies, one being in vernacular.

 

3. Now you can apply to all the authorities to up date their records and issue you fresh certificates/passport enclosing copies of the said affidavit.

As per law, you can change/correct the name of mother in your educational certificate within a period of maximum 2 years from the date of passing the said qualification. 

- However you can change your name after publishing the same in the official gazette in India . and further on that ground you can change the name in other documents .
