• Does Sale agreement made in one city is valid in another city property for sale deed?

Two parties(Buyer and Seller) are living in one city and property is situated in another city. So both did the Agreement to sell in their city. so this agreement to sell is valid for sale deed to be register in another city where property is situated and both city having different registry office but are part of same district and state.

Firstly the sale agreement cannot be registered if the same has been registered in a different city other than the city where the property is situated.

However if the sale agreement was by an unregistered deed, then you can get the sale deed registered in the city where the property situated.

Yes it can be prepared anywhere but it should be registered at the sub registrar office where the property is situated

Agreement to Sell executed between the seller and the buyer in their place of residence will be valid even if the property is located in a different place.

This is done under the jurisdiction of the Sub-Registrar under whose local jurisdiction the property is situated

1) builder will levy transfer charges on original buyer in event he seeks to sell the flat 

 

2) tripartite agreement has to be registered between seller, buyer and builder has to be confirming party 

 

3) bank will sanction the loan 

 

4) bank will make payment to seller if entire sale  consideration has been paid by seller

The solution for this is that the buyer, builder and the previous buyer have to enter into a tripartite agreement in which all the agreed conditions and terms will be discussed and incorporated accordingly. 

This will make your purchase proper,  perfect and legal.
