• Furnishing false information to a govt. auditor - is it a crime?

Hello,

Is it a crime to furnish false information to a Govt. Auditor? In this case it is a housing Co-operative Socy which gave false information for successive years during their annual audit. Who can file a complaint? and to whom should the complaint be addressed?

It is job today auditor to go through books of accounts , vouchers to verify whether accounts have been maintained properly 

 

auditor scrutinises all the registers maintained by society 

 

if any false information has been given by society complain to the auditor and send copy to  register of cooperative societies

The registrar of cooperative society is the competent authority and controlling authority of all the registered societies. 

If false information was provided by the society to the auditor,  then the members of the society can give a complaint against the office bearers of the society including the president with documentary evidences to the registrar of cooperative society

A. Any member of the society can file the criminal complaint for forgery, cheating and embezzlement of cash. It is advisable to issue notice to the President/Chairperson and secretary of the society

Q. whom should the complaint be addressed?
A. It is to be addressed to the registrar of cooperative housing society tribunal. Complaint is to be made against the Chairman/President, Secretary, Treasurer, Accountant of the Society and other managing committee members of the society. The complainant should be member of the society.

It is a crime. Any resident of the society can file a complaint with the Assistant Registrar of Co-operative Societies of that particular area.

yes if he is considered as public servant then its a crime. The govt auditor has locus to file the same or any other govt employee having authority can file FIR

Members can complaint to Dy. Registrar of Co-op.

Under the Act, the Dy. Registrar has the power to himself (suo-moto) to initiate an inquiry into the fnancial position of the Society. This means that even a single Member can in an appropriate case,persuade the Dy. Registrar to initiate proceedings.
