Our building is 50 years old. We have concealed ducts in walls for carrying electric wires from meter cabin to individual flats. Some of the members have changed the old wires with armature cables. But instead of laying the cables through the concealed ducts, they have just dropped the cables from their balcony to the meter cabin , which is on the ground floor. The cables are passing very close to the iron grills of the balcony of the ground floor flat, posing a risk to its occupants . The office bearers of the society are of the opinion that the cables do not pose any danger.The society has also not done the mandatory fire safety audit. What are options available to the residents of the ground floor flat ? Can they file case against the society ? Or approaching the fire brigade or local municipal corporation would be a better approach to solve the issue ?

You should give a representation to the RWA. If they do not acknowledge that it is a problem then you may approach the registrar. File a complaint with the fire department and local municipal corporation.
Approach muncipal corporation regarding exposed electrical cables

The cables have to be in concealed ducts since if they are left exposed then there is a possibility that the internal wires may get exposed and come in contact with metal grills which may result in a fire hazard

See what the response of the CFO is and whether he gives any directions to society to comply with
Ultimately if the society does not comply and even the CFO takes no steps for such compliance, you can file a writ petition in High Court

1. File complaint with the local municipal authority regarding the hanging wires and mark same complaint in CC to electricity department and fire department.
1. Make complaint u/s 381 r/w 482 of the BMC Act to the local BMC ward office and u/s 37 of the Fire Act to the local Fire Station, against such person/s and the Society for such nuisance and endangering the life of other residents.
The affected residents can first initiate about the danger posed to them by such cables in writing to the association and await their action or reply.
If there is not fruitful response, then a complaint with the local civic body may be lodged on this dangerous issue.
A complaint with the electrical department also can be made by the affected residents for taking proper action so that the danger can be removed.
Resident of ground floor can file suit against society for mandatory injunction to shift the wires in duct specifically made for this purpose.
This is clear threat and constant danger to life. Complain to police. Society opinion is insane and against law.
- Since, that cable is dangerous , and an incident may happen in future from the same.
- The ground floor residents should lodge their complaint before the management of the society , and if refused , then lodged a complaint before the Electricity department of that area and also with the municipal corporation as well.
