• Enrolment at the Bar Council, Delhi (BCI/Advocates Act)

Hello,
I’ve just graduated from a 5 year B.A., LL.B course. Right now i am aiming to appear for UPSC exam. So i was wondering is it necessary for me at the moment to enrol at the bar council just because I’ve received my LLB degree and i am not seeking to practice in the courts at the moment. Can i enrol later after 2-3 years if i change my mind?

Yes, you can able to enroll later as well. But if you have completed your graduate I will suggest to enroll it. When you join UPSC job at that you can surrender it advocates certificate back to BCI.

Hello,

  1. There is no bar to your enrolling a couple of years later if you choose to do for whatever reasons.
  2. In case you enroll now and appear for the exam and have to join services, you will be required to surrender your practice as you cannot practice and be employed at the same time.

It is advisable to enroll at bar council at the earliest clear the all India bar examination

1. Since there's no age limit to get enrolled as an Advocate, you can enroll after your trial in UPSC exam.

It's always better to get enrolled immediately after passing LL.B. because your experience counts from the date of enrolment as an Advocate.   In case you get job somewhere else, get the licence suspended till you are in service, thereafter you can  get it restored.  After retirement you can practice on the same enrolment.

You can't practice with your govt job in any law firm. You need to resign. Yes they ask a formal reason you can give any legitimate one

There is not mandatory the reason to provide at the time of enrollment later. If you are not enrolled at BCI your advocacy practice experience years will be not count if you still join the law firm. because later client checks that how many years of court experience do you have.  There is no harm to enroll now in BCI once you change your min that not to practice at that time you can surrender Advocate certificate  (Sanad) to BCI.

If you seek to Practise in a law firm later on then you will be needing a enrollment certificate and you will be treated as a fresher. 

so it is advisable to get your self enrolled with some bar council even if you start practicing after 2-3 years, atleast your experience will be counted.

No need of enrollment....

 

When you want to appear before the Courts, you're required to enroll in Bar Council. 

 

If you don't practice in any court of law, you mustn't enroll in any bar council.

Hello,

  1. If you choose to practice at a Law Firm, you have to enroll in the Bar Council before you can do so as will be required to be a lawyer on roll.
  2. Per say, you don't need to provide a reason for delay in enrollment, unless it is a huge gap. That you had been previously employed and therefore did not enrol earlier is no bar to your enrollment at a later date.

Ok , better enroll yourself now then and appear for the aibe. Being a qualified lawyer will not bar you from anything but you will be free from hassles if you can't make it in upsc.

You can delay the registration/bar enrollment. 

When at a later stage if you wish to enroll than a simple affidavit have to be submitted for the gap period

- Yes, you can opt any time to be enrolled as an advocate in any of the State Bar Councils regulated by the Advocates Act 1961.

- Further ,after registering himself , the candidate has to clear the All India Bar Examination (AIBE), and this exam is conducted by the Bar Council of India, and the candidate gets the certificate of practice upon clearing the exam. 

- Further , as per Section 24 of the Advocates Act , the followings are Criteria for enrolment as an Advocate: -

1. A person shall be qualified to be enrolled as an advocate if he fulfills the following conditions:

2. He is a citizen of India. Provided that a national of any other country can also practice only if Indians are allowed to practice in that other country;

3. He has attained the age of 21 years;

4. He has completed his bachelors in law;

5. He has paid the required stamp duty, which is chargeable under the Indian Stamp Act, 1899 and an enrolment fee payable to the State Bar Council. He has to pay six hundred rupees to The State Bar Council and one hundred and fifty rupees to the Bar Council of India. If such person is a Schedule Caste or Schedule Tribe then he has to pay one hundred rupees to the State Bar Council and twenty-five rupees to the Bar Council of India.

- Hence even after 2-3 year you can apply for enrolment , and for seeking to practice at a law firm is also required an enrolment.

After graduation you need to clear examination of AIBE  being conducted by BCI. If you clear the examination you get enrolled otherwise try until you succeed. 

It is better you get off UPSC first then any time before attaining age of 45 you may enroll with the Bar Council of State which would be selected by you will be admitted temporarily with conditions to clear AIBE of BCI .

You can very well defer the idea of getting enrolled with the bar council at a later stage I.e., after few years also. 

It is your decision,  nobody can restrict you on this.

If you are employed in a law firm as a staff you di not have to get enrolled as an advocate,  but you cannot practice as a lawyer in the court representing your law firm. 

Nobody will ask you the reason for delay in enrolling as an advocate even if you are doing it after few years. 

You may have to state what you were doing after completing your law graduation till the time you are applying for enrollment.

It's totally your call. It is not necessary to enroll but it is advisable that you do it because in case you decide to practice after 2-3 year, you can claim to have an experience of 2-3 years on papers. 

If you seek to "practice" at a law firm then you need to get enrolled. However, you might not need an enrollment if it is purely a corporate firm where you are not required to visit court.

You may get enrolled for practice as advocate at any point of time. The only requirement would be that you will be required to submit an affidavit depicting the reason of gap in getting degree and starting the practice.
