• Rules for resignation for IRMS after EOL

Inline as ADMO Probationer in Indian Railways and after completing 12 weeks training was posted at NR. I took three years Extraordinary Leave ( for study purpose) without salary and did my PostGraduation. I joined still as probationer after availing 3 years EOL. Now still as probationer, I am not getting job satisfaction because of not getting work profile for what my PG subject was.
I want to resign and pursue Super specialisation. What is the penalty and process for resignation.

Have to given any understanding or bond ? If not than can submit resignation to your OIC. You have to serve number a days as per probation rules.


Penalty only if you have given any bond or undertaking.

1) Resignations of Group A & B railway servants, other than those holding administrative posts, serving on railways may be accepted by the General Manager.

2) The resignation submitted by Group A probationers of different services undergoing probationary training in various Centralized Training Institutes may be accepted by the Heads of Centralized Training Institutes .

3) Resignation of all other Group A & B railway servants on Indian Railways/Production Units shall be forwarded to the Railway Ministry.

As per Specific Relief Act, if any employee quits before the notice period, the Employer can only recover the Notice pay, and the Company cannot force to serve the entire notice period.

- Further, the resignation decision is the employee’s decision, and the employer cannot sue for breach of contract, if the employee leaves without serving contractual notice. 

- Probationary periods are often applied to new employees as a means of determining their capabilities in a new job.

- Further ,the employer can terminate during the probation , and employee can also leave the job with the terms and conditions mentioned in the appointment letter for probation. 

- Further , if an employee leave the job during the probation period , then it not harm his career, and generally many company stipulates in contract , that during probation period either party can terminate the job with or without any notices.

- Hence, legally no penalty can be imposed , if your resign with a valid reasons .

Check if you have signed any bond. If yes you may have to fulfill its conditions. If no bond has been signed simply submit a resignation letter to General Manager of your railway

You would have been subjected to sign the terms and conditions while granting the EOL for study purpose.

You peruse the terms and conditions properly you will come to know what you are liable to pay to the government for resigning the job midway terminating the contract without any valid reason in the probation period.

EOL cannot be taken again. You want to resign then there muat be a bond period and if you leave then you have to pay the penalty. Refer to the contract.
