Hum 4 bhai and 2 sister hain. jinko vasiyat ke dwara apna apna hissa mil gya hain.
maine apne bade bhai se 20 year phle apni dukan se kamare mein jaane ke lie 3*10=30 ft ka rasta kharida jiski koi document nhi kraya.
Ab aaj wo mujhe dhamki deta hain ki wo rasta use wapis chahiye and bolta hain ki mein diwar todke rasta band krdunga and wo 30 ft apne mein mila lunga.
my question is-
1. mujhe aisi dhamki par kya karna chahiye?
2. agar wo diwar tod de to kya hum FIR krwa skte hain? agar haan to uski process kya hogi?
3. FIR se hume kya fyada hoga kya isse case bankar court mein chalta rahega aur hume prove krna hoga ki yeh rasta hmara hain jbki hum pr koi document nh hain verbally sodha hua tha?
3. agar wo diwar tod de to apan FIR ke saath saath apni diwar dwara bna skte hain?
4. agar diwar todte samy mein agar hatha paai kru to kya koi criminal activity mere khilaf ho skti hain?
5. kya avi hum koi evidence photo ya video recording kra skte hain ki yha rasta hmare hisse mein hain? kya yeh hume koi help krega agar koi criminal activity hoti hain to? recording kis type ke camera se honi chahiye reel wala ya digital?

1. If you bought the land from him then it is your great mistake of not getting a deed of sale registered in your name.  Now you can file a suit for specific performance of contract with alternative relief of easement.

You are suggested to be proactive and install CCTV or Hidden camera to record the movements etc. so that in case of any misdeed by your brother, the activity is recorded and one proof is ready with you. Also serve the legal notice to him mentioning that he has taken money and did not do the registry or documentation. Also, you may file the case of injunction to refrain him from capturing that area again.

धमकी का तो कुछ नहीं कर सकते पर अगर तोड़ने की कोशिश करे तो पुलिस को कम्प्लेन कर सकते हो I जैसे ही वो तोड़ने की कोशिश करे १०० नंबर पे डायल करके पुलिस को बुला लो, या पहले से ही पुलिस में कम्प्लेन कर दो की वो दिवार तोड़ने की धमकी दे रहा है I

ये मत बोलो की तुमने खरीदी , बस काई सालो से ये ऐसे ही चल रही है I FIR से पुलिस उसे चेतावनी दे देगी I

दिवार बचने के लिए हाथ पाई कर सकते हो पर उससे पहले १०० पे कॉल कर देना I

दिवार और रास्ते की वीडियो कर लो और फोटो रख लो I
नोटिस का जवाब दो की रास्ता कॉमन के लिए है I कोर्ट स्टे दे देगा , दिवार न थोड़े जब तक केस चल रहा है

You Please prepare digital  video of property which would show the proof of existence of wall and path being used by you.

Please issue legal notice to your Brother to abstain from preventing you to use the path and property which is being used by you for the last 20 years.

Under Easement Act you have legal rights to use right of way ,water and light if using continuously for the last 20 years.

If you engage in fight with your Brother for your legal rights and anyone of you get injured then Police would register assault case as per evidence and medical evidence of each parties

Your self acquired property you can deal with it according to your wish.

Settle the property among the children to avoid future litigation.

Even though you say it is an ancestral property, it may not be actually ancestral property, this property would have been inherited by you through your father as your share,  hence you are the absolute owner of that property besides your own (self acquired) property.

In this situation since you anticipate a dispute between yor son an daughter for share of property, you may better transfer your property to your son's name by executing a registered settlement deed, which cannot be challenged by your daughter. 

If she intends to file any partition suit also,it would not be maintainable nor it would be tenable in law. 

You may not go for the option of transferring the property through a Will, because it may be disputed and the legal battle may stretch for a period of even a decade during which the parties to the civil dispute may be logger heads, frowning upon each other and losing the cordial relationship too.

You may discuss with an experienced advocate and proceed as suggested.

- As per laws , you cannot transfer the ancestral property to your son only without getting the consent of your daughter. 

- Legally your daughter can claim equal share in the ancestral property after your demise but not during your life time. 

- However, you can transfer the entire self acquired property to your son , and daughter having no right to claim even during or after you life. 

- Hence you cannot gift the ancestral property to your son , and your daughter can claim equal share later on. 

- Better transfer the self acquired property to your son completely and half of the ancestral property .
