• Eligibility for annual increment

Sir,
I was working in PSU and I join another PSU in the month of April 2012. The recruitment was made by issuing NOC from my previous organization. Just i want to know that whether i am eligible to get increment in the month of July 2012 or I will get increment in next year..

Dear sir,

You mentioned as 2012 but now its 2020 annual increments will be done in the month of April as per the policy of your company you have check with the hr based on your performance either there is increment or not .

However due to pandemic this year no increments anywhere you have to adjust for this year!!

As protection of pay is applicable in your case then date of increment should not be change, resignation should be technical.

Since you have NOC from tour earlier PSU and the present PSU accepted the NOC which indicates clearly that your present employer has accepted you and your employment in continuing process from previous year to the present financial year. 

This method and calculation of increment goes in your favour and the present employer has to increase your salary in the month of July,2012.

 - As per rule, Pay protection is a way of safeguarding the pay. and conditions of service of employees whose pay is adversely affected by organisational change , it means to allow the individual to find another post at their original pay band or to adjust to the lower salary within the protection period.

- Further, when an employee applies for in the same or another department through proper channel and on selection he is asked to resign the previous post for administrative reasons the resignation is called technical resignation.

- Since, you was working in PSU , and after getting the NOC , you have jointed the another PSU , then it will come under the term Technical resignation. 

- Hence, you are eligible for the pay protection , and the increment accordingly.

Getting incremental benefits depends on number of years you serve your employer. 

This varies with every organisation. 

I am not sure about the service regulations of your organisation. 

Refer to such Rules. 

If you fulfil the criteria you can be entitled to such benefits.

Yes you are eligible to get increment in July 2012 if you changed the job after giving technical resignation which make you eligible to get pay protection.
