• Hospital charged unwanted bill of 74000 as cheated

My kid was diagnosed with Coa, vsd in heart, i have vidal health insurance, while claiming bill from health insurance they put 74000 money as extra for Single donar platlets, actually these sdps are paid me manual. Also i have original bills. Hospital has charged for 6 SDPs in claim. I want to procees with consumer court for cheating and fraud of hospital. Please help me out

File complaint against hospital before consumer forum and seek orders to direct hospital  to refund your money with interest 

 

also seek litigation costs and compensation for mental torture undergone by you

You can file case in the consumer forum Or court. 

 

A complaint is an allegation made by a complainant. It is in written form. It consists of the statements and some important facts to establish a case that a consumer has suffered loss or damage due to deficiency of any service. 

 minimal fee is required for filing a complaint before the district consumer redressal forum for medical negligence cases.

When a complaint against medical negligence is filed, the forum sends a notice to the opposite party to submit its version of the case within 30 days after admitting the complaint. After doing proper scrutiny the forum will ask either for filing an affidavit or for producing evidence in the form of judicial precedents, expert opinion, etc.

This appears to be an unfair trade practice and also a fraudulent act by the hospital authorities.

You may first gather all the evidences to support your claim and pleadings in the court of law.

Then you issue a legal notice demanding their explanation or justification for this exorbitant charges.

You can file the complaint against a private hospital to the Civil Surgeon of the area where hospital is located or to any higher authorities of the health Department of the State or center or to any other office under which the affairs of the hospital are controlled.

But be careful in case the complaint is frivolous and baseless.

First of all you should collect all evidence in order to support your complaint so that it does not turn out to be frivolous and baseless and is held to be false .

If the complaint is proved to be false then the hospital authorities can put you on the run on various accounts which it may prove to have suffered in pursuance of your false complaint.

One should indulge in such methods only if his case can be proved beyond doubt and the complaint is sure to succeed.

If you have such supportive evidence then you can further get relief awarded by moving the Consumer protection forum or by civil suit remedies.
