you should approach education officer of muncipal corporation in delhi and obtain permission for running a play school

2) in residential area you cannot use the premises for commercial purposes , take written permission of resident association

The licensee would need license from municipal corporation

1. you can obtain the permission from the concerned education officer with intimation to the municipal corporation,

2. you are also required to obtain permission from the concerned residential association, if registered since the locality is residential

No permission is required from govt authority only a shop and establishment license is required for the said place

Dear querist,

The only requirement which is being mandated by honble Delhi High Court is that NOC from all the owners of the residential apartment has to be taken for opening a pre primary school. Apart from that the procedure is same as of you are operating from a commercial property.

It is never legal to carry on a coomerciac activity in a residential place.  If any govt gadzate or notification specifies the contrary then you can do the same.

1. Play School is a "commercial activity" and according to a recent SC judgment, no commercial activity can be conduct in a residential only complex.

2. For other areas / purposes, the local Civic Authority (Municipal office) provides permission from the same after getting NOC from other residents, for any objections /nuisance etc....  IF you are looking to upgrade your facility in near future, THEN you would also need permission from the Education Inspector & the Fire Dept.

Since you are going to conduct commercial activity, firstly you need to obtain permission from Society of your Apartment.

Approach DEO of concerned area and obtain permission for running play school.

You need to obtain license for running the said school from Municipal Corporation of Delhi.

A residential apartment cannot be used to commercial purpose.

The society also may not permit to run a play school in the residential apartment.

The Law allows certain profession to set up their office in the apartment that too in only one third space of the residence and not permitted to utilise the entire space of the apartment for any commercial activity.

The local civic authority may also not grant any permission to convert the residential property to use it for commercial purposes. 

The aspiring edupreneurs tend to worry about the legal permissions and formalities involved in establishing a preschool.

 In India, there are a few states that have laid down certain rules and regulations with respect to running a preschool in a residential area. For instance, a person has to get the approval(s) from the DDA land authorities in Delhi, HUDA sectors in Haryana, Development Authority in Noida, Goa & Rajasthan. 

There is no specific legislation or certification for setting up a play school but permission from the MCD.

You will have to register under the provisions of State Pre School Act and then with the permission of the Society only you can operate a pre-school in the apartment.

You can open play school in your apartment but for that you will need permission only from your association and education department for necessary licence. 

A school will be considered as commercial activity and for that you need permission for commercial activities in residential area.

In A play school many children take admission and a peraon earns from it.it also attracts a lot of noise and hence permission from the society should be taken but Commercial activity cannot be undertaken in flats.
