i am Indian Muslim working in Saudi Arabia. i want to marry a Pakistani girl from Karachi. Please guide me as per current situation and laws.

1. Can she get the citizenship and how.
2. how to start the process .
3. is she can stay within me in Saudi Arabia and apply for her nationality through Indian embassy ?.
4. after the marriage, does government ask to leave India due to unstable situation between India and Pakistan.
5. i don't want to loose her, so please guide us the confirmed way to convince her parents about the nationality.

 your wife can apply for conversion from tourist visa to X visa .two main documents are needed for Tourist to X Visa conversions: 1) Submission of a copy of registered Marriage Certificate. 2) Report from the relevant local police station about marital status, including observations, confirmation of living together, and security clearance.

 

2) 

section 5(1) (c) of citizenship act provides that a person can be registered as indian citizen if such a person is married to a citizen of India and is ordinarily resident in India for seven years before making an application for registration.

3)or making an application for registration under section 5(1) (c) applicant has to fill in Form 111 under rule 5(1 )(a)of citizenship rules . if applicant has in preceding 12 months continuously resided in India the said period would be taken into account . further in last 8 years preceding 12 months if applicant has resided in india for not less than 6 years said period would be taken into account .

1. She can get the citizenship of India after marrying you by applying to Ministry of Home Affairs, Government of India. Depending on the prevailing circumstances most likely she will be given Indian citizenship on the basis of her marriage to an Indian citizen U/s. 5(1) (c) of the Citizenship Act 1955.

2.  She has to apply to the Ministry of Home Affairs, Government of India.

3.  She can apply through the Indian Embassy in Saudi Arabia.

You can marry her in Saudi Arabia and then apply for visa for her to visit India as she would be your wife.the Indian government woukd give her a permit. Then after a few years she could apply for permanent citizenship.

Once she gets the citizenship she cannot be sent back.

She can stay only on visa granted by Saudi Arabia. Her Sharia marriage should he accepted under Saudi law.

Applicable for Pakistan , Bangladesh, Afghanistan

  1. Any Hindu person ( male or female ) from Pakistan , Bangladesh , Afghanistan who have Indian spouse is eligible to get resident X visa and later citizenship.
  2. Any female person ( any religion ) from Pakistan , Bangladesh , Afghanistan who have Indian husband ( any religion ) is eligible to get resident X visa and later citizenship.
  3. Muslim males from Pakistan , Bangladesh , Afghanistan who have Indian wife is not eligible to get citizenship. They may be given some relaxation on visa but they will never get citizenship. However his wife will remain Indian if not renounce her citizenship.

You being an Indian and she a foreigner, hence your marriage can be registered under special marriage act.

If you both are currently residing in Saudi then you can approach Indian embassy at Saudi and start the process for getting your marriage solemnised through the embassy and get it registered through Indian embassy.

1. If the Pakistan rules allow you to get married in their soil then you may apply for visa and also comply with other requirements to get married at Pakistan.

2.  Getting visa to come to India will be as per the general rules because if you get married in Pakistan then you may have to get the marriage registered in India in order to recognise her as a person married to India.
