• Whether drying of clothes outside the window is allowed

Our is 19 story building and I am living on 7th floor . My question is that drying my clothes outside my window is allowed? Is there any law which prohibits? Managing commitee has taken objection. Kindly help.

Drying of clothes outside window is an eyesore and if resolution is passed by MC you cannot dry clothes outside windows

See there is as such no law on same you can dry your cloths outside your window without causing inconvience to others if some resolution is passed on same then legality of same has to be looked into.

There  is no such law restricting you to dry cloths outside the window.

You may ask the association to notify the law by which they are restricting you from doing so, if they dont quote but put pressure on you then you may take legal action against them for  nuisance and tortures.

- Drying clothes outside the window is not a violation of the society by laws , hence no society can prohibits for the same,

- Since, the window and terrace is under your possession and a part of your property , hence under the arena of your possession , you can do any thing , with the view of nuisance to others.

- You should lodge your complaint with the managing committee of the society , after mentioning that you want to use your window for the purpose of drying clothes, and they should allow for the same.

- If refuse, then you can appeal before the Registrar of the Society .

The law allows the association to frame their own rules within the ambit of law enacted by govt. This objection is nothing but moral policing.

It's just stupid objection there is no such law or regulations as per MCS Act 1960 or byelaws of societies. It's only as per the whims and fancies of the managing committee they make any rules they want

1. There is no law.

2. You have to read the rules of your society. If there is a rule which says that a flat owner cannot dry clothes outside his own window then such rule is illegal. You are free to dry your clothes on your window.

 if erect is not objected by the resident welfare Association then you can do so in apartments the resident welfare Association is the ultimate authority which controls the maintenance and up keeping up the common areas if Europe is creating problem to others then and for the sake of peace in the society and do not get into any differences with other society members you have to make arrangement to get your clothes dry at appropriate place and not to create inconvenience and not to create inconvenience to others society have the right to make rules in this regard I weigh nothing is provided in the Apartment Act but any rule which is made by the resident welfare association and is rectified by the members at large in their AGM is applicable and cannot be challenged if there is nothing in the rule which violates any of the law in force

There is no law of the land which prohibits drying of clothes in particular manner .

Few society restricts such drying of clothes in window but breach of it does not attract any penalty.

Ans:

Each society follows a set of bye laws in its society. If the society in which you reside follows a set of rules which disallows you to hang clothes outside, then being the member of the society you are supposed to abide by it. 

It is only for the reasons like security, appearance of the society etc., that such are to be followed.

Dear Sir,

Drying clothes outside the window "  IS NOT A VIOLATION OF THE BYE-LAWS,  hence any such penalty CANNOT be levied.

Make a written protest to the mg.committee of the society, for reversal of any penalty levied on the above clause (point no. 2 above)

If the mg.committee fails to do so, then appeal before the deputy registrar, who will certainly strike-down the levy of penalty by the society.
