Hello, 
I am an NRI. Getting married this year. My to be wife is in India currently. I have a few questions related to legal requirements for the name, address change for my wife. What are steps to be taken for name change for wife? What documents are needed? Can I change wife's name on marriage certificate itself in Maharashtra?

See firstly the marriage has to be registered with original name.

Then after your wife has to make a name change affidavit, publish in 2 newspapers and gazettee publication for legally changing the name.

For address change an affidavit before notary can be made as address in passport also has to be changed on your presence.

1. While applying for Marriage registration mention the said wife's name as "Anita (Paternal Sunita + Father name + surname)

eg. Anita (Paternal name Sunita Patangrao Kadam).

2. IF the Marriage Registrar accepts the above, then the new name shall be duly reflected in the Marriage Certificate and shall remain valid for all futuristic legal purposes.

3. If above is not possible THEN  "AFTER" marriage conduct name change proceedings via a Govt. Gazette & Public Notification Publication.

for changing the name and address, you would be wife may file an affidavit before the official of the Gazette department of the State and after publication in the official Gazette the name can be changed.

the copy of that Publication be annexed with all the applications for the purposes of changing the name.

Copy of Identity Proof, documents related to Birth Certificate/High School's Marksheet, Adhar Card, and passport size photographs will be required.

 

after filing the correction application, the name can be changed in the marriage certificate.

You can change the name after you get married to her. You need to do a Gazette notification and paper publication. Even marriage is not mandatory to get her name changed she can do it without getting married too.
