• Girl cheated me for money in the name of love

A girl cheated me for money (5lakhs) in the name of love. I have the conversations where she proposed me. Our personal and private photos. Most of the money i sent her thru net banking (have proof for it). She married someone and tried to hide it from me. I sent our convo to her father and husband. They haven't responded anything. Can i be charged for any issue? Can i recover the money atleast?

Dear Sir,

You can file a complaint with the local police .if the police doesnot register a case of cheating and criminal misappropriation, a criminal complaint before tje magistrate. All the relevant sections can be mentioned after going through all the facts in detail. In fact I am already appearing in a similar case in supreme court where in similar case the girl after enjoying money of the man married but later on left him saying that she doesn't love him and will return the money spent by him if she develops love for him

You can file a criminal complaint against her for cheating and criminal breach of trust. Also send a legal notice to her husband demanding payment of money.

- As per law, breaking up of an engagement/proposal of marriage is a breach of contract in legal sense and a suit for damages for that can lie, but otheside , An engagement does not obligate a person to marry the one to who he/she is engaged.

- Since , she has refused to marry , and cheated in the name of marriage , and thereby it caused you great mental harassment and monetary loss , hence your mentioned details are amounts to Defamation , and a criminal case can be filed. 

- As per Supreme Court, One is bound to tolerate criticism, dissent and discordance but not expected to tolerate defamatory attack,

- Under sections 499 and 500 of the Indian Penal Code, defamation is a criminal offence. The offence is punishable with up to two years imprisonment, a fine or both.

- Further , if you have proof of payment of the said amount , then you should lodge your complaint against her with the police and higher official against her cheating.

- If, police refused to accept the same, then you should file a petition for lodging FIR ,before the magisterate under section 156(3) on the ground of said complaint ,even refused by the police. 

- Further, on the proof of payment, you can also file a recovery suit , after stating that she has taken a friendly loan from you.

Everything can be taken by force but not the love. We all know this believe this and understand this. 

Love and marriage can not be enforced by law.

There shall be no contract for love and marriage.

Then what case will you file? Breach of love. Or breach of marriage. 

You spent 5 lakhs after the girl. So in return you need her love. This is simply ridiculous.

Forgot about the money you spent. 

You can not make a false case to recover the money. Judges are not so fool.

Try to understand what is love. Then you will understand  why there is no law for love related issues.

MY OPINION THAT you have so many evidences of mental harassment , misinterpretation,misbehavior, cheating,all are strongly established against that lady which have proved legally, you have so many legal ways to protect yourself, you should move immediately.

you can file the private complaint in the court of concerned judicial magistrate, then the Judicial Magistrate after recording you evidence summoned the accused person against them you have file the application. alternate you can file recovery of money suit before jurisdictional civil court.

- As i mentioned above, firstly lodge your complaint with the police  , and one copy should be forwarded to Commissioner or DSP level official .

- If, no action within a period of 7 to 15 days , then file a complaint case before the magisterate under section 200 IPC , with 156(3) CrPc . 

- The magisterate will call a report , and further order for an FIR for cheating and defamation as well. 

- Further, you should to issue a legal/demand notice to her for getting the refund of the paid amount, after mentioning that she has taken the amount as a friendly loan from you. 

- If, no response within a period of 15 days , then on the ground of this demand notice and other payment proof , you should file a recovery case against her.

Forget about the girl who has cheated you because she will never be loyal or faithful with you for the entire life even if you are planning to marry her somehow.

However if you have evidences for having given her money, then you may send a legal demand notice to her demanding the return of the money taken by her from you, followed by a money recovery suit against her.

You cannot force her to marry you against her willingness even if she is not married now.

Thus, any complaint for cheating also will not be tenable or maintainable in  law.

Therefore instead of wasting your time on taking revenge on her for  deceiving you, better you may initiate action for recovery of money from her.

The police may not be of any help to you in this regard since there is no provision in law for this cheating activity against men.

See.you can send her a notice for the amount , you can also file a complaint with police.

Dear Sir,

loan is a loan, and a gift is a gift. If you can prove your money was loaned and not given (through emails, texts, witnesses, notes, etc.) and she's got the money to pay a judgment, threaten to sue her in Small Claims court if she doesn't pay you, and if she doesn't pay up, sue her in small cause court.
