• Abused on WhatsApp

Can i sue some if he has absued me on Whatsapp and im having all the chat history sent from his mobile to my mobile. Can it be used legally in indian court to prove the charges. What will be the punishment for the same.
He also keep calling late night and one or two calls a day but i don't answer to anyone of his call as i had clearly message him if you have any issue visit my office to talk one to one but he says why should i visit your office and keep on WhatsApp message and calling non stop.
He even visted my house two times today i even made a video recording as he was standing outside my house and talking non stop about me with my wife my wife even said this is no place to talk for any concerns as he has said visit his office and talk to him he has not refused to talk only you don't want to visit his office. 
He has spolied my image in my neighborhood as he has no right to visit my home for any reason.
Please advise what can be done to put him behind the bars.

1. You can file a Police FIR, requesting investigation and charge-sheet, for offences like harassment, intimidation, breach of trust etc.... against the person, supported with all relevant supporting documents.

2. IF the Police does not take action, THEN you can file private criminal case u/s 156(3) Cr.P.C., in the local Magistrates court, seeking directions to the Police to investigate and file charge sheet. The said Person may come down for settlement.

Keep all that chat record safe make a hard copy of all that go to police and lodge the FIR against him he will be behind the bars and in addition to it you can also use that he is threatening to kill me... Police will look after him itself...

The offender can be booked under IPC for trespassing, house breaking and violating your privacy. You must file a complaint with the local police and also send the same to the cyber crime cell. The sections under Information technology act would be also added in the FIR and a high ranking official generally is marked as Investigation officer in such cases. The action must be taken immediately.

Dear sir,

whatsapp chat is adissible in  the court of law. But firstly, it is advisable to send him a legal notice to him on the basis of which case can be established further and he can be stop.

You cannot sue him on the basis of whatsapp messages or chats.

You can lodge a criminal complaint against him before the local police  for the offences of torture, nuisance, threats, blackmails, abuses, intimidation and many more such charges.

You can block his number on whatsapp and all other social media so that he may not be able to have an access. If he visits yor house again you can call police to your home and give a spot complaint on this

  2. As if he thinks that you have done something wrong with him then he should have gone before the court of law but surely not at your house.
  3. Next time if he does that then I would suggest you to call the police and get him arrested arrested for defaming publically your image.
  4. No, you will have to file a police complaint if he has only sent to you the concerned messages, but if to other people also then to both the departments.
