• Extracting images and description for my ecommerce website

I run an ecommerce website can I use I sell large number of products. There is one public listing website www.searcho.org where sellers list their product and buyers buy from them. My question is can I take information from the website like images product description without permission to use on my website since anyway I am going to buy from those sellers. What is the procedure/ permission do I need?

See you need permission from the seller to display there products for your website you cannot take images from website as for same seller and manufacturer has copyright over same.

No you cannot take the images without a written permission, else it amounts to Copyright violation.

If you are caught, then first thing they will do is to issue DMCA notice and later take down your website. But since you are commercially using these images, you will be directly sued and your website will be taken down.

You should carefully read the disclaimer and copyright policy before taking the images.

Let me give you an example. I do buy lot of products from Amazon. And amazon spends a lot on advertisements and creating attractive images, etc. Now if I take it from their website, am I not taking away from their profits?

So, the right way to do it write to the website, and take their permission to use the images. You might have to specifically tell them which images are you interested in.

1. Check the website whther it has any copyrights over the images published in the website.

2. If not then anyone can copy the images. otherwise the person copying the images can be sued to recover damages.

3. So check the website first to find out whether it has exclusive rights over the images on its site.

If any how you are going to buy products from them than make one more agreement that you are going to use all products details in physical and digital advertising purpose.

The information you can take from that website is contact Information of sellers if there is access of that information.

but product information for selling the product cant be taken from that website cannot be taken without Permission of that particular seller to post his information and products on your website as that can land you in legal consequences of Copy right act and stealing of information from other websites.

It depends on what kind of information you are using from those websites. Usual Terms and Conditions of the websites restrict such usage but if you are using the details of the product then it cannot be termed as infringement as the products are in the market and you are also selling the same through legal means. But it will infringe the rights of the website owner when you just copy the complete contents and reproduce.

You can not use images, but you can use the description.

If you want to use images then inform the seller about the same and take prior permission.

However if the images have been launched by company only then you do not have to take permission

Taking a list of those items from their website for commercial purposes may not be advisable.

In the event of any objection or reporting of infringement of intellectual property rights, it may adversely affect and may even attract criminal actions.
