My younger brother from BANGALORE and girl from HYDERABADH MARRIAGE was performed 2/11/2017 HINDU customs arranged marriage and couples settled in BANGALORE, After 3 weeks GIRL left to to hyderabadh mothers place blameing Bangalore climate /food/husband/inlaws are unsuitable for her.Girl strictly avoided sexual relationship with her husband and strictly replied not inte
rested in sexual activity.my brother filed RCR in Bangalore family court, and girl did not attend RCR proceedings in Bangalore family court and it is under Argument stage.girl while returning back GIRL took all her gold jewellery of ours and hers (, only cot/bed/alimirah/clothings/suit/ is left in Bangalore .)
MEANWHILE girl filed Divorce case in hyderabadh family court ON 24/12/18 claiming DIVORCE & 30 lakhs marriage expenditure inclusive of gold ornaments.under section 13 a (1) .AND girl father is a ex policeman pensioner having contacts with higher level police officials (.my brother does not have any property in his name and monthly salary is Rs 20,000 (Twenty thousand only in Bangalore )
1) sir Two hearings my brother did not attend hyderabadh family court case and is it a offence not attending the court case ?
2) Girl father is a ex policeman is their any danger to brothers life if he attends family case in hyderabadh ?
3) our parents are 80 plus he is looking after them with health issues ,can he shift the family case to chennai / any city is their any legal provision ?

1) If your brother didn't attend the case and if he is in India than court might issue warrant.

 

2) For alimony ask your brother to produce payment/salary proof of 20k in the court. So court will grant alimony accordingly.

 

3) What is her father that does not make much difference ask your brother to be present in the court.

1) If he fails to appear even after substituted service the court will order the proceedings to be ex-parte against. It should take around 4 more hearings to get it ex parte. 

2) no need to worry, even if her father is commissioner of police, law is equal to everyone.

1. Your brother's wife has demanded Rs.30 lakhs also in addition to marriage.

 

2. If yiur brother does not attend to the hearings, ex-parte divorce decree can be passed with direction to pay an amount as decided by the Court. So, it will be prudent on the part of your brother to attend to the hearings.

 

3. He can apply before the Supreme Court for getting the case transferred to his place but it is very unlikely that he will get the favourable order from the Apex court.

 

4. Retired police officer will not be able to influence the Court and he can hardly be a threat to the life of your brother. However, he can lodge a police complaint against him if he apprehends danger from him.

2. Your brother can hire some advocate to appear in his behalf. Ex parte order would not be in his best interest.

1.  In family court, the presence of both the parties is essential until and unless ther is a strong reason for their absence. In case he is not able to attend he may inform his advocate about it.

2. no such problem, in cse he is threatening then your brother may inform court about this.

Dear client 

Don't worry about the father in law of brother and police officials as in HMA case there is no role of police officials. But they can effect you if she files the case of 498 A against your brother. 

  1. In civil court it is not an offence to avoid court hearing but court can proceed against you Exparte and give order according to girl petition and can pass one time alimony of 30 lakhs if your brother or his lawyer will not go to next hearing of case. 
  2. There is no danger to your brother life if he scared to go to court then he can send his lawyer
  3. The situation of parents and salary of your brother can help him in case of maintenance but it can become less but court will not cancel the maintenance petition if filed by his wife. 
  4. If he also want divorce then let him go to court and accept the petition of divorce without objection but disagree with her claim of 30 lakhs.
