• What is the way i can get the index 2 of my flat?

Hi,
My name is Mrunal lad.My parents have a flat in pune location and they are no more. However we don't have the index 2 of the flat yet.We have approached the mamledar kacheri office and found that the original registered document is been misplaced by the people in office.So we are trying to get the index 2 on the agreement copy that we have at home,however the problem is that there is not registeration stamp on that copy, but I have a Xerox of the agreement which states that it is a true copy.Also I have the Xerox of registration receipt.
Still the people in Mamledar kacheri office are denying to give the index 2.
Please help what can be done in this case.

1) index 2 is summary of any document registered with sub registrar. registration act requires preparation and maintenance of number of indexes to be maintained for purpose of record keeping . it is proof that document was presented for registration 

 

2)file RTI application with mamledar office as to why index 2 has not been done of your flat 

 

3) it is not your fault that original registered agreement has been misplaced by the office

1)Index 2 contains the total transaction amount for your property. It will not contain any info on what is paid or remaining. Index 2 is a part of sale deed.

2)index 2 is a proof of your registration of sale deed document.

3) make an application to get a certified copy of Sale Deed.

file a Complaint against the same to the superior Officer and try to approach the appeallte authority in the said office. If not resolved writ petition in HC is only remedy for you.

See from the receipt of registration get number of document get certified copy of registered document and apply for index 2 in the sub-registrar office where it is registered.

Hello,

If  the original related to your flat has been lost then the same is not your fault. It is the duty of the office to maintain to keep the record and the same is known as index  precisely. 

You may file a RTI.

Also file an application to obtain certified copy of the index

1. File an RTI application requesting the Index-II, based on the registration receipt you are having. File this the local office of the registrar of sub-assurances.

2. Many Index-II, also can be downloaded from the IGR website.

In the given circumstances the proper authority is High Court which issues  a direction to Mamledar accordingly without insisting any other documents.  Please file writ petition before High Court.

You may discuss the subject matter with a local advocate and issue a legal notice to the Mamlatdar office in this regard and demand the desired registration copy, if they deny citing the law involved in it yo can take up the mater through court of law for relief and remedy.
