what basis you state it is ancestral property ? if property was subject matter of litigation and consent decree passed sons would have share in said property . if said property was sold sons would only get share in the property
Dear Sir I have Q if there is ancestral property past on from forefathers. Were A Father had 3 children from which 2 sons 1 daughter. Now the land was divided by father by getting consent decree passed in the Suit of 1939 under Bombay High Court to which only 2 sons was given rights to the property nothing to the Daughter. Now the Land was recently sold , can sons of daughter claim that land.

SIr this property is passed from great great grand father to grand father like that . now in 1940 when there owner was my great grand father having 3 children s 2 sons & 1 Daughter. NW that time great grand father decided to give this property to only to 2 sons not the 1 Daughter. NW sir my Q is can Heir of the daughter claim Right in this Land .

if your great grand father died in 1973 on his death all 3 children would have equal share in the property .
But sir they have got court decree from Bombay high court saying that this property is divided between Great Grand mother n 2 Sons not the daughter. After the death og Great grand Mother the property is divided equally between the 2 brothers,

was daughter party to suit proceedings ? did great grand mother leave a will ? .do you hav copy of court proceedings and court decree?
frankly you have to meet local lawyer pay his consultation charges show all documents in your possession and then decide your next course of action
1) No Daughter was not the party of suit proceedings. 2) NO will was made by grand mother as they had court order says that all the rights of the property is to be shared by 2 sons after grand mothers death. 3) yes have a photo copy of the court order of 1940
