About document verification of result awaited candidates
Sir I am result awaited candidates in jvvnl teachnical helper requriment 2018 .department allow me to take participate in requriment process but due to their hurry in document verification. I am not able to produced my document. My final result not come yet. They didn't clarify the document verification date but now they are telling that document verification will be done on 20 September 2018 and my result will come in between 15 October to 31 October. They mention only in advertisement that candidates need to produced their qualifications on the date fixed for document verification but not mentioned date of document verification in the advertisement. What I should do ?? Pls give me legal advice on this matter

I talk with department md but they told me that you have to produce final marksheet at the time of document verification.

What is the specific difficulty being faced by you in appearing before them for the document verification? Please explain in detail.
In case there's any genuine difficulty, move a repreentation befor them followed with a writ in the High Court if your repreesentation falls on their deaf ears.

You should immediately file a writvoetition in the Rajasthan hc so that you may get adequate relief. Th court will allow you to participate in the selection process.

inform them that you would get mark sheet only by end of october 2018 hence unable to produce documents sought by them for verification purposes . furnish all other documents in your possession on date fixed for verification
Why cannot your produce your marksheet? What is the difficulty that you are facing in producing your documents?

If you were eligible to give examination being a result awaited candidated then you may go on the required dates of the documents verification and get the other documents verified with an affidavit that result for a particular exam is awaited.

As I already mentioned that in the advertizment written that running candidates passing out on 2018 can apply for requriment process but the Candidate must possess requisite qualification on the date fixed for document verification. This exactly advertizment. But in above statement they not clearly mention exact date of document verification so I filled my form now I got select in written exam but my final semester exam result will come in 15th to 30 October & and now surprising me they told me to produced final semester mark sheet on 20 September 2018. That is impossible for me . Now I want to know that is this is not a case of 420 because they not clearly mention exact date of document verification in the advertizment written thats why I filled form but know they are telling me to produced final semester mark sheet that I can't. I want to know that is this not frud with me by requriment department thAt they not give me correct information and take my mony money and important time for preparation for exam and now they are telling me me a new date for document verification that is not mentioned in the advertizment. Simply I want to know that this is same case that or not that I will tell anyone in written that I will give him a bike on his selection in IAS but before he got his result either he will select or not I told him to produced the selection prof of IAS AND denay to give him bike before his final result that proofs weather he will select or not. Beacuse i not clearly mention the exact time that when will i say him to prof of his selection. Is this not a matter of injustic with him ?? The same condition department done with me that department not clearly mention exact date of document verification in the advertizment thats I beacome victim of 420 case. Now pls suggest me that not what I should do? Can I go for writ petition in high court & then what is % chance for me that I got time for document verification till my final semester result.

You may file a writ petition.
But you do not have a very strong case as it is believed that document verification will be done soon after the result and this extra time is given so that the candidates who can get the mark sheet by the time of declaration of result may apply.
Be that as it may, you may go ahead and challenge the same by means of writ petition and ask the court for an interim relief.

You can give an affidavit for the missing documents and can seek time of one month to produce same. The department shall consider or your request.
Sir given an application and file an affidavit stating details and producing your marksheet in the stipulated time before the department in case then also you are not allowed keep record of this application and affidavit and file a writ petition before the high court for direction to accept you candidature, The high court shall accept the merits in the case,
There will be some provisions for deferring the finalization of such candidates who are yet to receive their results becasue you were allowed to appear in the examination even before you were qualified for the post.
You can appear before the authority on the date that had been notified to you, explain the situation and seek for a date after the date of declaration of your result.
Your case will be considered.

You carry a letter of undertaking with you at the time of document verification and request the authorities by convincing them about your inability to produce the same, if there are any other candidate of the same nature, then you all may make a combined representation to the authorities in this regard.
Alternately you can file a writ petition before high court to stay the process of recruitment for the said reason until the result are declared.

This is not a case of IPC section 420.
You may approach high court with a petition to stay the operation of the process of recruitment owing to the facts as explained by you to the authorities and seek a stay of the recruitment process till the results are declared.
