Purchase resale flat from 1st owner
I want to buy resale flat , here agreement of sale is executed between builder and owner ,however sale deed is not executed but possession letter issued to owner. here society is not formed yet.
In this case if I want to buy flat I should execute sale deed between me and builder or between me and owner.
pls advice.

Ajay Sir, owner took NOC from builder and its mentioned that it will be transferred to my name and owner paid the transfer charges. In this case location is outside muncipal corporation so in 7/12 utara owner name won't be mentioned then in case agreement of sale is cancelled due to some reason how owner has right to sale the flat.

that means there is no need to execute sale deed by 1st owner with builder and I can enter into sale deed with owner and if builder cancels the agreement of sale which he made between him and 1st owner , in all cases Builder don't have ownership in any way ,am I correct?

Agreement is valid till date and its not cancelled , however if in future will builder has right to cancel the agreement of sale.

DO I need to execute agreement of sale first OR direct sale deed with owner.? As owner doesn't have any loan from bank ?
