• Construction on agriculture land

We are about to purchase 1 acre agriculture land in Sohna, Gurgaon. We intend to use it to grow food for our own consumption and occasionally use it as a weekend getaway. We have been told that construction upto 5% of the area is allowed for residential purposes on the land without the need for any approvals or CLU. Is this correct? If not, what is the procedure for building a permanent tenament of around 1400 sq feet?

Firslty, Sir, every state has their own law with regard to the construction of residential purpose in a portion of the agricultural land.

Secondly, in fact it was allowed long time back when it was needed to have someone watching on the crops so should have a small house on it.

Thirdly, and no permission is required only an affidavit need to be given to the local land owing agency in your area for constructing the same disclosing the reason for the same.

The Haryana government has decided to grant permission for the change of land use (CLU) within 45 days, if the application is complete in all aspects

2) The department grants CLU permission for residential/ industrial/ commercial/ institutional/ farm house/ recreational use, under the Punjab Scheduled Roads and Controlled Areas Restriction of Unregulated Development Act, 1963 and its rules, 1965. The Act lays down that CLU permission is to be granted within 60 days in case of industries and 90 days in other cases. In order to prevent unauthorised construction and regulate planned urban development, the department declares controlled areas around towns and public institutions and prepares their development plans, under the Act

3) for constructing farm house of 1400 square feet apply for permission with the govt

If you intend to construct a permanent structure beyond the permitted limit you may have to first get NA conversion permission and then the plan approval from competent authorities.
