• Information regarding OBC NCL certificate

Hello,
I am a resident of Bangalore in Karnataka State. I belong to the Gowda community. Which is one among the list of caste/community eligible for OBC as published by the NCBC.
In the list for the state of Karnataka under entry number 156, the caste/community mentioned is

 "Vokkaliga,Vakkaliga,Sarpa Vokkaliga (Rural areas only), Uppina Malaga Vokkaliga, Gouda/Gowda,Hallikara"

The above mentioned details is exactly as in the information recieved by me for an RTI which I had filled regarding information with this topic.

When I approached the taluk office to apply for OBC-NCL certificate, they say that they are not supposed to issue it for Gowda community in Bangalore as it is under BBMP (not rural)

Is the (Rural Areas only) applicable for all the communities mentioned in the list. As I can see, it is after 'Sarpa Vokkaliga' only.

Request you to provide clarity with this information.

Hello,

From what you have mentioned in the question it looks that you should get reservation. They are misinterpreting the list and therefore are providing you reservation. File a writ petition in the HC and pray for declaration of your caste as one of the backward caste as mentioned in the list.

Dear Client,

Bad interpretation and consideration of list,

Rural is with Sarpa Vokkaliga and bracket closed followed by COMA which in self and very clearly shows, no such condition attached with GOWDA community according to region.

Challenged the order.

Sir the rural areas is specifically mentioned for the Sarpa Vokkaliga community not the Gowda or others the Taluk officer is interpreting it in bad light and the interpretation is wrong and erroneous.

See first ask taluk officer to give the thing in written if he refuse to make certificate on this ground.

Then file a writ petition before the high court seeking direction for the taluk officer for the certificate.

You get this information i.e., whether the gowda community people residing within BBMP jurisdiction are entitled to get the privileges or concessions with regard to OBC NCL Category through RTI act.

You clarify this and confirm.

the Rural Areas only is not applicable for all the communities mentioned in the list. Only 'Sarpa Vokkaliga' would be treated for rural areas only.

The Taluk office is rightly misinformed and you can try to sought it out with them, else you'll have to file a writ of mandamus in high court to get the OBC NCL certificate.

Take endorsement from the concerned authorities and file a writ petition before the High Court. You will get justice. The law is as follows:

In Vokkaliga Community more than 116 Sub-Caste are there and Classified below state wise :

Karnataka: Gangatkara, Marasu, Kunchitika, Reedy, Namadhari Vokkaliga, Nadavaru, Bantaru, HegdeVokkaliga,Seetigara (Shetty), Halli Vokkaliga, Alva, NayakaGowda, Hallikara, Halakki Vokkaliga, Dasa Vokkaliga, Sarpa Vokkaliga.

Vokkaliga is a Backward caste in Karnataka, so is Lingayats both enjoy reservation under category 3A and 3B. But both communities claim unofficially that they are forward caste for social acceptance. in the modern world caste is becoming irrelevant. When late Devaraj Urs constituted the "Havanur Commission" to look into the reservation for backward classes in Karnataka, it was found that vast majority of Lingayats and vokkaligas were backward too, only a few in their respective communities were rich, so vokkaligas was includes in reservation and later due to political pressure from Lingayats , they were too included in the list. But the same man not apply to central government.
