• Can a relieving letter from job be the substitute of noc

Sir, I am currently in a PSU Job. some month back I applied for another govt job and duly intimated my current employer and requeated for NOC too.But I neither received any NOC nor received any acknowledgement of intimaton from my enployer. Meanwhile i applied for the new job duly informing the exam conducting authority that i was already employed elsewhere.I appeared in the exam and got selected. .Now i want to resign my current job and my employer has accepted my resignation. But as per the policy of the new employer , working candidates have to produce NOC from their present employer. As i will resign the job i can not bring the NOC. But can produce my resignation letter and the relieving letter from my earlier job. Will the relieving letter be accepted in lieu of the NOC ? As they have only mentione the NOC .PS: I have cited personal reasons for resignation. have not mentioned the fact that i m resigning to join another job.Thank you.

hello,

a resignation letter and a relieving letter is sufficient but you should have informed your former org that you are leaving the job as you have joined elsewhere. it is not a problem for now but in certain strategic org, they do scrutinise the former job etc of the employee. I think the papers are sufficiently but you should inform them. you must not have informed them as you did not get the NOC when you went to give the exam. you can very well cite your application that you had submitted at that point in time.

Your relieving letter would not be accepted in lieu of NOC

Your new employer would insist on NOC from ex employer

See you can talk to consult to your new employer yes the reliving letter can be considered as the NOC as of there are no dues in previous job and you are legally relieved in case they need separate specific NOC from previous employer seek same from the authority in case it is not issued can issue a legal notice to employer stating complete facts and asking for NoC.

There are strict rules in government organisation for documents in case they do not accept relieving letter and the old employee after notice does not give noc file a writ before high court seeking direction for old employer to issue NOC.

hello,

well, I don't think that there would be any problem. you have all the necessary documents. so need to create unnecessary hassles. go ahead and join the new Org.

Acceptance of your resignation by your previous employer coupled with the issue of relieving letter amounts to implied issue of NOC to join the new job.

Separate NOC then becomes academic and optional
