• OBC non creamy layer clarification

Does Ganjam reddy Tamil nadu fall in OBC category of central list. Has got BC certificate for state and checked in central list and could not locate. Please clarify.
For OBC NCL salary my income from other source is < 1 lakh and salary is > 8 laks in private limited company am I eligible for NCL?

To determine your OBC NL status your parents income is considered and not your income

You are not eligible for OBC NL if your parents income from business is more than Rs 8 lakhs per annum

for government employees only their position in the office is the criterion for non-creamy layer status. Excluding all Class I employees and direct recruits of Class II cadre, all other govt. servants having income greater than 8 lakhs are still eligible for the OBC non creamy layer certificates

The Madras High Court Bench here has directed the Member Secretary of National Commission for Backward Classes to reconsider the plea of the Reddiar Welfare Association based in Madurai to include the ‘Ganjam Reddy’ or Reddy (Ganjam) caste in the list of Other Backward Classes (OBCs). The Association argued that such inclusion would help the people belonging to the caste group to benefit from communal reservations in education and public employment.

A Division Bench of Justices M. Sathyanarayanan and J. Nisha Banu passed the order on a writ petition filed by the association on the ground that Ganjam Reddy caste group was omitted in the list submitted before the Mandal Commission at the time of identifying the OBCs in the State. The judges said that they were of the view that the petitioner association must be afforded one more opportunity to substantiate its stand.

The association claimed that it had approached the National Commission for Backward Classes with a request to include Ganjam Reddy in the Central list of OBCS. However, the Commission turned down the request in January and held that the plea could not be accepted. It also advised the Centre under Section 9(1) of the NCBC Act, 1993 to reject the request for inclusion of Ganjam Reddy caste in the Central list.

Hence, the association challenged the validity of the January 22, 2016 proceedings of the Commission and claimed that it was in possession of overwhelming materials to show that it ought to have been included in the central list of OBCs. Opposing the plea, the Union Ministry of Social Justice and Empowerment as well as the National Commission contended that there was no need to review the decision taken by them last year.

The Tamil Nadu government has submitted before the Madras High Court that it has been persistently requesting the Centre and the National Commission for Other Backward Classes (OBCs) to include Reddy (Ganjam) community in the Central list of OBCs.

After hearing submissions from counsels, Justice K Suguna, said, ".. in view of the submission made by counsel appearing for respondents 1 and 2 (Union Social Justice and Empowerment Secretary and Chairman of National Commission for Backward Communities), respondents are directed to pass orders with regard to this issue within a period of six months from date of receipt of the copy of this order."

She added, "While passing orders, they are directed to take into consideration the recommendations of state government also since the relief sought is with reference to the state of Tamil Nadu."

The combined salary income of the husband and wife, if both are employed, should not exceed Rs. 15 lakhs and anything in excess may be calculated towards annual income of the family.

1. The said cast is not treated as BC as per central list. There are many such cases where a caste declared as BC in a State has not been considered so as per Central list.

2. If yourincome is more than Rs.8 lakhs per year you are considered as out of the OBC NCL category.
