the Public Gambling Act of 1867, , makes it a crime to either run a “public gaming house” or to even be present at one, and provides criminal penalties for both.

1. If the games are banned then you cannot go on with such games. YOU ARE NOT ALLOWED TO DO ILLEGAL AND BANNED GAMES....BE AWARE....

The Police would insist upon you to obtain the permission/License under the Provisions of The Karnataka Police Act or Licensing And Controlling of Places of Public Amusement Order, 2002, in order to start online quiz, billiards, caroms and chess competitions by collecting entrance fees.

In this regard the Hon'ble High court of Karnataka has been directing the police not to insist on mandatory license from such registered societies/clubs.

You too will need to file a petition and take such an order.

1. None of these games is banned in India. The only requirement is that you must seek license from the competent authority. If the license is refused then you may file a writ petition in the High Court.

2. You must consult a local lawyer who alone can tell you who is the competent authority to grant the license in the concerned state.

There are no dedicated laws for online gaming, online gambling, online fantasy sports, online poker, etc in India. In fact, there are no laws that can effectively deal with legal issues of online gaming, online gambling, online fantasy sports, e-sports, etc in India.

Indian gaming and gambling industry is presently suffering from lack of a techno legal framework that can manage online gaming and online gambling related issues. For instance, the cyber law due diligence (pdf) and Internet intermediary liability law in India are two such techno legal requirements that the central government has failed to enforce in India so far. This also applies to online gaming and online gambling industry of India as well.

In State of Bombay v. R. M. D. Chamarbaugwalal, the Supreme Court of India ("Apex Court") held that competitions (games) where success depends on a substantial degree of skill will not fall into category of 'gambling' (i.e. gaming as defined under state enactments); and despite there being an element of chance, if a game is predominantly a game of skill, it would nevertheless be a game of "mere skill".

Sikkim is so far the only state in India which has enacted a statute pertaining to online gaming i.e. Sikkim Online Gaming (Regulation) Act, 2008 ("Sikkim Gaming Act"). In terms of the Sikkim Gaming Act, an interested person can obtain a "license" for the purpose of conducting online games such as Roulette, Black-jack, Pontoon, Puntobanco, Bingo, Casino Brag, Poker, Poker dice, Baccarat, Chemin-de-for, Backgammon, Keno and Super Pan 9.

It has been also held that conducting online games for profit cannot be included in the scope of trade, business or commerce as envisaged under Article 19 (1) (g)8 of the Constitution. Further, sports' betting is an offence in India and individuals earning money from bets laid on games of skill do not have the constitutional protection of Article 19(1) (g).
