• Buying agricultural land in Karnataka by a non agriculturist resident of Punjab

I am a retired banker from Punjab. My annual income is less than 25 lac. I want to purchase agricultural land in Karnataka. I am not a resident of Karnataka.

Can I purchase ?

Yes, there is no law which can stop you to buy a land for agriculture, and contribute in our country's progress.

If you have paid tax for the same amount (which I know you have) there is no stopping.

the amendment empowers deputy commissioners of districts, instead of assistant commissioners, to grant permission for non-agriculturists to purchase agricultural land under Section 80 of the Karnataka land reforms Act.

However there are restrictions in the form of permissions granted for persons taking agriculture bonafidely on conditions such as

(i) that the transferee shall take up agriculture within one year from the date of acquisition of land, and

(ii) that if the transferee gives up agriculture within five years, the land shall vest in the State Government subject to payment to him of an amount equal to eight times the net annual income of the land or where the land has been purchased, the price paid for the land, if such price is less than eight times the net annual income of the land.

A. You or your family members must be an agriculturist in any state of India If you want to purchase agricultural land in Karnataka. In addition to this, your income shall not exceeds more than 25 Lakh.

B. However, you can purchase the same by obtaining prior permission from the Deputy Commissioner.

C. You are entitled buy a Plantation land in Karnataka. To purchase this land, you don't required to be an agriculturist.

D. You can acquired the agricultural land to run educational institution by taking special permission under section 109 of Karnataka Land Revenue Act.

E. Finally, you can purchase the land after the conversion from agricultural to non agricultural purpose which means when land loose agricultural nature.

Under Section 79 a & b of The Karnataka Land Reforms Act, you should satisfy:

that your family income is not more than 25 lacs per year.

as on 01.04.1974 and on wards you should prove that your belongs to an agriculturist family.

If you can satisfy both of this you can purchase the agricultural land in Karnataka.

Or you may need to take permission from the Deputy commissioner to purchase agricultural lands under he Act.

1. For purchasing agricultural land in karnataka you shall have to be an agriculturist for which you shall have to produce a certificate to that effect.

2. Even being an agriculturist as stated above, you won;t be able to buy agricultural land in Karnataka if your yearly income is more than Rs.2 lakhs.

3. Based on the above criteria, you are not qualified to buy agricultural land in karnataka.

Actually you can not buy but,

Since you are non-Kannadiga and not from agriculturist root, you need to get permission from deputy commissioner of revenue department. ( There are procedures, please talk to a lawyer ) .
