How can i proceed to take my money back from my collegue. I have given 7 lakhs to my collegue but he is not even paying interest and not even answering phone call and absconded from ofice.

You may initially send him a legal notice.

After that you can either file an FIR against him; or

may file a summary suit for recovery of money

1) how was money advanced by cash or cheque?

2) any agreement entered into with the borrower ?

3) issue legal notice to borrower to repay loan amount with interest

4) if he fails to pay file summary suit for recovery of money with interest

5) also file police complaint of cheating against your friend under section 420 of IPC

Send a legal notice for recovering of your principal loan with interest.

If the notice fails to help your cause, file a money suit.

Also, register a FIR.

Hi

If you have the proofs of giving him money like bank transfer details or any Witnesses if paid cash then first send a legal notice via a lawyer and wait for the reply, if no reply is given in the 15 days of the receipt of notice then file a police complaint saying that he is threatening you to kill if you ask your money back.

Also you can file a recovery suit in court for the recovery of your money. Your recovery suit will be filed in district court as for the amount upto 20 lakhs can be filed in district court.

As told earlier send him a legal notice immediately and thereafter lodge an FIR and civil suit for recovery.

Respected sir...

What proff do you have in this regard that he have taken money from you..If you have any of proff you can file a recovery suit against them ...If he had given you blank cheque you can file 138 of N.I act ...Sir court wants proff if you have you can go against him ...

You have another option to lodge FIR against him in police station police will itself see the accused but all these such will be happn only if you have proff ...So tell here what proff do you have ....

Hello,

It depends on the terms of agreement of giving friendly loan. You are not entitled to earn interest if you donot have license to lend money. You must have some documentation done before giving away such a huge amount of loan. Is he absconding only from office or his home as well? You have both civil and criminal legal remedies depending on the circumstances of the dealing or transaction.

If you have evidence for giving him the said amount i.e., bank transaction details, you can issue a legal notice to him at his office address and home address.

Get the notice returned undelivered, then you file a money recovery suit in the civil court.

First all the six people go to his house, talk to him and try to get at an amicable solution for this problem, if he is not agreeing to return then initiate proper legal action as per law, if need be you may even lodge a criminal complaint for the offences of cheating.
