3)if however the DAV is not releasing pension obtain court orders to direct DAV to release mother pension
Can a "One and the same person" affidavit be published in the gazette
My mother's name (Ammujakshy K) has been entered as A.Madhavan in his defence pension papers. When my father passed away this year, the pension account, which is a joint account, was converted to single account by showing her SSLC certificate. However, when we applied to the Directorate of Air Veterans (DAV) for family pension, the papers could not be processed because my mother's name in in their records is "A. Madhavan". We have got a notary's certificate saying that these two are one and the same person, but we have been informed by DAV to publish the name change in the gazette. The notary had informed us that this is not necessary since this is not a case of name change. Is it necessary to publish this affidavit in the gazette?Is it even possible to publish?

Yes you can get it published in the Gazette and such publications are allowed.
Gazette notification is the last step in completing a name change procedure. Though name in most documents like Drivers’ licence, PAN card, Voters’ ID and many others can be changed without notification in Gazette, some authorities like Public service commissions and public sector banks do insist on Gazette notification, in case their applicants have applied in their new names. Hence, it is safe to have a Gazette notification ready.

2. then it should be made published in offical gazette.

Yes, gazette publication is possible, Publication is preferable in a Central Govt. and yes some Govt. Departments do insist for publication of this kind of affidavit.
How can this be published in the gazette? The gazette form for name change asks for original name as per SSLC book, new name and reason for changing name. Since my 'new' name is the same as the one in the SSLC book, which is to be given as the 'old name', what should I give as the old and new names, and where do I show the name A. Madhavan, which is the name automatically given to me after my marriage though not officially published. Even if I try to change my name NOW to A.MAdhavan (which will then be against my PAN card and passport), it will be legally effective only from now, and not from the date of my husband's pension parers in the 1970s. OR, ..Is there a separate gazette form for publishing "one and the same person". If so please let me know how to access it.

your lawyer has correctly guided you that this is not case of name change
There is vast difference in the name hence it would be advisable to go for change of name.
You can apply the charge of name by adding alias or aka to the existing name.

You just get your name changed from original to the currently proposed through gazette publication the other things will be taken care of automatically.
