• Buying a flat in kodathi, varthur having panchayat approval and e-khata

Hi, 
I am planning to buy a flat near sarjapur main road i.e in kodathi, varthur Bangalore. But the builder is having only panchayat approval and e-khata. Is it safe to purchase the flat.
 Please assist me.

You have to check whether title of builder is clear and marketable

2) check whether building plans sanctioned by the authorities , commencement certificate issued or not

3) check track record of builder

4) you should purchase flat after OC is issued that building has been completed as per sanctioned plans

If land falls under panchayat jurisdiction and builder has all the approvals in place you can go ahead and purchase the flat

These days the panchayat approval is not valid neither the e-khata issued by panchayat is valid.

You have to consult a local advocate with all relevant documents in respect of this property including the DC conversions if any.

You may proceed only after getting a satisfactory opinion from a good and experienced lawyer.

The builder is DS Max. He has building plan approval. Also have DC conversion. But he told as it under panchayat, he cannot have OC and CC. He also mentioned that once the area comes under Bangalore urber i.e BBMP premises. We need to take care of A-khata conversion and bare the charges.

This should actually have BDA approval. If it does not, there could be the problem of regularization that might have to be faced at a later date.

Check for deviations in the building or layout. That must be the reason that the builder might not have gotten BDA approval. BDA approval is also required to ensure that the land comes under residential usage. If not, BDA could take over the property tomorrow if it has been earmarked for other purposes. Even panchayat constructions and layouts are asked to get BDA NOC to prevent this from happening.

Do the neighbours have layout approval from BDA? BDA generally provides layout approval and not building approval.
