• Property tax

Hi sir

I am selling my appt in Bangalore with registration due on 21st July.

As I have already paid the property tax for the financial year 2018 , should I ask the buyer to compensate me on a pro rata basis so we share the property tax?

Just wanted to understand on the property tax payment responsibility in the year of sale?

1. yes, you can ask property tax as compensation because ultimately he will be benefited.

2. according to section 69 of the indian contract act you have to reimburse that tax.

It is your duty to pay the property tax up to date.

If the current taxes paid is up to date then you cannot claim pro rata tax amount from the buyer.

Moreover this will depend on the agreement and the conditions that have been agreed between the buyer and the vendor.

This has no legal provision or there is any law governing this position, as per your query.
