• House construction

A corner plot in a housing society. The construction map of ground floor approved by the authority. Construction of ground floor completed. However, when completion file submitted, authority realized that we have corner plot..and design map approved by authority is wrong and needs some amendment. Please advice as construction of house is already completed. In addition we assumed same map for first floor...hence it is also half completed.

1.Since the construction was made as per a sanctioned plan there is no question of any demolition.

2.To adjust their fault they will have to make arrangements in the layout which must not affect your structure.

3. if there is no stay order on further construction you can continue with the further constructions.

4. So act accordingly.

Any deviation in the construction from approved plan is likely to draw attention to demolish or levy of heavy penalty for regularisation.

If you are confident that this plan was approved by the authorities before starting the construction work, you may aproach court seeking an order of injunction or stay of operating the order of the authorities concerned.

Since the fault in not your's but of the Authorities for they made a mistake in not taking the note of the fact that your plot was a corner plot, they have to regularise the construction already done by you. For the construction which is to be done henceforth, assure the authorities that they you'll comply with all the applicable bye-laws. You may approach the High Court if the Authorities are bent upon not to regularise your construction.
