what are terms and conditions of agreement . ? if you are giving him rights to sell your product in a given area and terms are reduced in writing mentioning period , his responsibilities for sales of your product , your obligations under contract for confirming orders and making delivery of the products he would be your agent .

Whether an agreement has been made between you and the person? The clauses mentioned in the agreement will hold the key to decide whether the representative partakes the character of your 'agent'. If the right to sell the products has been given under an agreement and he acts on your instructions then he will be your agent.
