• Land dispute

We had a agreement on a bond paper with a guy on a plot saying that we will playing the amount on monthly installments and after completing it the registration of the plot will be done. Now after we have completing all the installments , now he is delaying the registration and also the plot number which he has mentioned in the agreement is sold to some other party. its already been two years and now showing the other land even that he is delaying the registration. Please advice on how to proceed legally and get the registration done.

issue legal notice to seller to execute regd sale deed in your favour as full consideration has been paid

2) if he refuses file suit for specific performance

3) also file pol;ice complaint of cheating , criminal breach of trust against seller under section 406, 420 of IPC

1. File a suit for specific performance of contract.

2.In the said suit seek injunction also so he may not sell the proeprty beofre you get decree from court.

3. if the seller is a professional land broker or developer then you can file the case in consumer forum instead of suit for specific performance of contract as such case in consuemr forum takes lestime and cost.

You first issue a legal notice demanding him for registering the property.

Let him agree or deny the same.

This legal notice shall be an evidence along with the unregistered sale agreement for filing a suit for specific performance of contract before court to enforce the agreement.

No doubt an unregistered sale agreement is not valid in law, but you can use this as receipt for payment and can claim refund with interest.
