• Succession Certificate

My father expired recently. He had some Savings accounts and a Demat account in banks in Vadodara. He is survived by my brother in Ahmedabad and myself in Mumbai.

My question : Can I approach the courts in Ahmedabad or Mumbai to get a Succession Certificate, or do I have to approach the courts in Vadodara only ?

Where did your father death take place?

If he died in Mumbai then succession certificate can be applied in Mumbai other wise it has to be filed in Vadodara where bank accounts are located

You shall have to file the application for the Succession Certificate with the Court of Vadodara.

1.Succession certificate can be applied for where the person has breathed his last.

2.Howeevr if he has not permanent place of residence then it can be applied for at the place where any of his assets is situated.

3.So accordingly determine the place of suing.

1. If no nomination has been made by him then his legal heirs i.e his widow and children have to obtain a Succession Certificate from the competent civil court. The civil court in Vadodara alone can grant you the certificate as the liquid assets are within the local limits of its jurisdiction.
