• Indemnity Bond on missing papers

Hi,

Builder has lost the two papers of the original registered agreement and now they are providing me indemnity bond for the same.

I have an doubt whether the document should be registered document of notarized document.

indemnity bond can be notarised. registration is not required

1. If the original title deeds is lost then certified copy can be relied on.

2. The furnishing if indemnity bond provides further security.

3. Since you have not mentioned details of the original documents I can not advise whether you should proceed to buy this property.

The indemnity bond cannot be registered document.

It is legally valid to the extent of its recital in it.

You have to verify the contents of the indemnity bond indemnifying the loses to what extent in case of any dispute over the missing documents arises in future.

Get it vetted by a local lawyer before proceeding.

It should be registered. Do not be induced by notarization. It should be registered.

The indemnity bond is not a registrable document.

No law makes the registration of an indemnity bond compulsory. So even if it is not registered, it will not affect its enforceability.

It can be enforced on the basis of the contents in it and legal validity.
